While speaking with journalists, the Executive Director, Saphira Global Center for Social Development, Mrs Yil Fomwul Gonsum, a filmmaker and social activist, with passion for humanitarian work said the project was embarked upon because of the low sensitisation on health and hygiene in particularly in the target community.

She further said that similar programme would be carried out in hard to be reached Christian community in the state very soon.

She added that community intervention hardly reaches the beneficiaries saying the programme was facilitated through crowd-funding with a major supporter from Area Manager of Molfix for North East, Terry Chukwunoso Eze donating ten cartons of Molfix Sanitary Pad called Molped.

In her remarks, Ms Jemila Idris, the Chief Executive Officer of Hanan Initiative for Women and Youth said her target community engages in open defecation and different kinds of health risk activities stressing that outbreak of diseases often begin in these hard to be reached communities and later gets to the general public.

She stress that the group had earlier in September organised a health talk in the community where participants raised concerns on health issues specifically in the area of hygiene management and environment stressing that the women urged Plateau State Government to return the monthly sanitation in the state.

Plateau State:Appeal Court Judgement, J.T Usani Coast To Supreme Court.

By, Giwa Alex, Jos

The governorship candidate of 2019 general election under People Democratic Party (PDP) Gen.J.T Usani is coasting to the Apex court of the country Supreme Court.

This to challenge the appeal court judgement on governorship election tribunal delivered 29th Nov, 2019 in Jos the plateau state capital ,which ascribed to Simon Bako Lalong as not only qualified to contest the 2019 election, but “Eminently “qualified.

The intention of the immediate past senator of the 8th National Assembly was made known in a press release through my whatsapp message in Jos the plateau state capital.

According to the press release signed by the senator media consultant Yiljab Ibraham read that the retired general in the Nigeria Amry cannot afford to throw the towel at his critical period particarly when there are many issues that needed to be strengthened in the judgement.

“Governorship Candidate of the Plateau PDP in the 2019 election, Lt. Gen (Rtd) Sen. Jeremiah Timbut Useni, has instructed his legal team to prepare and proceed to the Supreme Court immediately to challenge Friday’s judgment of the Appeal Court which affirmed the decision of the lower tribunal.”

“The decision was taken during a review meeting with the legal experts and General Useni. He praised them for holding strongly to the tenets of the profession and in bringing the issues in the petition to the forefront. He commended the lawyers for standing firmly on the side of the rule of law and democracy.”

Useni is determined that certain issues contained in the judgment must be straightened in the interest of justice, democracy and the future of Nigeria’s children.

“Our cause is the right cause. We should not make the law look as if it is not important. Let the Supreme Court declare whether lying on oath is not against the law.”

“He described the judgment of the appellate court as a surprise, especially having dismissed the two Cross Appeals of the Cross Appellants as lacking in merit and an abuse of court process.”

“Sen. Useni said he was also surprised that the judgment, delivered by Hon Justice O.A Otisi completely avoided making any pronouncement on an earlier judgment of the Supreme Court which reversed the decision of the Court of Appeal expunging the testimony of 21 of his witnesses.”

He however thanked PDP officials, stakeholders, and supporters for standing strong and united all through the period the case lasted at both the tribunal and now the Court of Appeal. He assured that the mandate of the people of Plateau State to him and the PDP is sacrosanct and will still enjoy his support and commitment.

Appeal Court Judgement, Garuba  Pwol Advice  PDP To Shield Their Sword.

By, Giwa Alex, Jos

The legal luminary,G.S Pwol(SAN)has advice the people Democratic party (PDP)to shed their sworn and close rank with the ruling All progressives Congress in plateau State to move the state forward.

Although is the constitutional rights for them to go to the Supreme Court over the judgement, but you most not pull the string to the end before you proof a point, come let amend the fences and let move plateau forward.

Chief Pwol (SAN) who is the counsel to the 2nd respondents Simon Bako Lalong of the All progressive Congress (APC) give the advice in an interview with our correspondence at the appeal court sitting in jos the plateau state capital immediately after the governorship election judgment who give victory to the incumbent governor Simon Bako Lalong.

“There is no point dissipating energy or trying to proof a point, both APC and PDP we are one plateau state, let team up and build a veril plateau state for the common good of the masses. “

Although the PDP has their constitutional rights to approach the Supreme Court, we are ready to met them on the merit of the case in accordance to the law of which I don’t doubt in my mind that their opinions will not be different.

The Senior Advocate Of Nigeria (SAN) said the judgement of the appeal court made up of five justices reaffirm the judgement of the lower tribunal that is made up of three justices.

” After giving due considerations to the argument and counter argument, processes in the files right from the tribunal come to the conclusion that what lNEC did is right by declaring the 2nd respondent winner in the governorship election conducted 23rd Feb,2019 is right.

This has help further to buttress the point that the governor Simon Bako Lalong who contested under the platform of All progressives Congress (APC) won the governorship election in the state contrary to the insinuations that he didn’t.

Pwol said the judgement of appeal court today has also go along away to put to rest the eligibility of the 2nd respondents Simon Lalong that he not only qualify but “Eminently “qualified.

“We are fully satisfy that the justices that deliver the judgement base on merit ,without fear, favor affection or ill will. “

Hate Speech Bill : Our Party Is The Architect Of “Hate Speech” — APC chieftain.

By, Our Reporter

The All Progressive Congress (APC) been advice to apologize to the people of Nigeria for the pains and hardship the party has inflicts on the people for inability to fulfill its electoral promises of “Change”they promise Nigeria citizens and stop pursuing “Hate Speech Bill”proposing death sentence for offender.

As there is no smoke without fire.

“If the millions of Nigerian youths can have something doing to earn a living, they will not have time for “Hate speech”.

“if people are allowed to elect their leaders in a free and fair election there will be no “Hate Speech”.

“So, something gave birth to hate speech and that is what the Senate should address.

The former Publicity Secretary of the All Progressives Congress(APC) in Niger State, Comrade Jonathan Vatsa, has lambasted the 9th Assembly of the Nigerian Senate for the proposed bill seeking death penalty for anyone convicted for hate speech.

While addressing selected journalists in Minna, the Niger State capital, the former Commissioner for Information, Culture and Tourism in the state described the move as not only laughable but a direct invitation for anarchy.

The APC chieftain also advice the 9th Assembly to also propose a bill that will apply for lands in the 36 states, including the Federal Capital Territory, Abuja as did for Ruga to be used as cemetery for hate speech offenders that will be killed.

According to Vatsa:

“I call on Senator Aliyu Sabi Abdullahi the proponent of “Hate Speech Bill ” to also propose a bill that will ensure we have separate cemetery for offenders so that we can have it as tourist sites with inscriptions ‘Hate Speech’ cemetery because the offenders may also include those of us who have benefitted from “Hate Speech”.

“What a shame.”

Vatsa wondered why the (APC)-controlled Senate should never, ever contemplate such a “draconia and unpopular law,” saying: “We the (APC) rode to power in 2015 through “Hate Speech”.

“We (APC) brought hate speech to Nigeria politics and I am one of them.

“As a Publicity Secretary of the APC, I know how we used hate speech to mobilize Nigerians against the then ruling party.

“And it paid off because Nigerians eventually hated the Peoples Democratic Party.

“Before 2015, Nigerians did not know anything like hate speech.

“In fact, since the return of democracy in 1999, we are just hearing about hate speech.

“APC as a political party brought hate to politics in form of propaganda.

“The truth must be told: we are the architect of hate speech and nobody complained about it.

“We enjoyed it and it worked for us.

“If we think we have failed Nigerians in our change promises, we should be bold enough to tell Nigerians that we are sorry, we couldn’t deliver, but to try to cage them by trying to introduce or recycle Decree 4 of 1984 in the name of hate speech is unacceptable.”

The APC chieftain while blaming the Senate Deputy Whip, who is from Niger North Senatorial District, Aliyu Sabi Abdullahi, warned that the proposed bill for death penalty for hate speech “might consume all of us”.

Vatsa said rather than proposing death penalty for hate speech offenders, it should be death penalty for corrupt leaders in this country because “corruption and injustice gave birth to what is now being called hate speech.

“If there is justice, equity, fairness and respect for rule of law, there will be no hate speech.

“But when people are being marginalized and denied their right, surely there will be hate speech.

“You cannot stop people from expressing their freedom of speech.

“If the Senate is proposing death penalty for hate speech, then what will they do to Boko Haram, armed bandits, kidnappers, oil bunkers and treasury looters both politicians and civil servants?

“All these things are worse than hate speech.

“There are more pressing issues to Nigerians that the Senate should look into and address instead of wasting their energy on an unpopular bill like this one that will not see the light of the day.”

Vatsa however believes that there are more to the proposed hate speech bill, adding: “If the rumor of President Muhammadu Buhari nursing the ambition of third term is correct, then they need death penalty for hate speech to silence everybody who will want to oppose him.

“But the Senate should know that he who lives in a glass house should not throw stone because they cannot be there forever.

“When they leave the Senate, the law can catch up with them.

“Again, if the money meant for constituency projects are utilized for the purpose it was meant for and the people begin to see dividends of democracy, there will be no need for hate speech.

“If the millions of Nigerian youths can have something to do to earn a living, they will not have time for hate speech.

“If people are allowed to elect their leaders in a free and fair election there will be no hate speech.

“So, something gave birth to hate speech and that is what the Senate should address.

Plateau State Appeal  Tribunal :Mike Ozekhome Pray Court To Return  Borrowed Mandate By Governor Lalong To J.T Useni

By, Giwa Alex, jos

Chief Mike Ozekhome (SAN) counsel to governorship candidate of the People Democratic party (PDP) in plateau state in the 2019 general election Gen. J.T Useni has pray the court to retrieve the borrowed mandate by governor Simon Bako Lalong to Gen . J.T Useni the rightful winner of the election under contention.

As the legal luminary Ozekhome said, its impossible for two Obas, Ezes and Emirs to be in one palace ,one most give way to the other.

The Edo state born Senior Advocate of Nigeria(SAN)Dr. Mike Ozekhome stated this during the hearing of the governorship appeal tribunal between governor Simon Bako Lalong (APC) and J.T Useni of the (PDP) in an interview with group of journalists at the appeal court premises sitting in jos the plateau state capital.

Que: sir,the court has just hear your governorship election appeal, how did you feel, and what is your hope?

President Mohammadu Buhari’s case with Atiku Abubakar is totally different from the fact of this case ,just as the Heaven is different from the Earth, and in law ,case is an authority on what it’s related .

You cannot transfer unrelated fact from one to another,in this case, governor Simon Bako Lalong affirmed in the trial tribunal as put down in trial tribunal pages 278-279 gives different names ,qualification ,non of them tied to any particular names, when they ask him in form (CF001) Exhibit (31), have you ever Change your name, he said “NO” by putting dash “-” the tribunal found that because he put dash meaning “NO”.

The name of Simon Bako suleh which is on the secondary school qualification is never tied to him in any of the documents.

The tribunal after finding that he gave false information ,surprisingly with all respect turned around and said Oh! this false information is not substantial enough to contest an election .

If the electorate are going to vote, they should be able to know who they are voting for, they should be able to know this is A, B or C.

Otherwise ,as I told the court today 22nd November, 2019 during the appeal hearing of General Jeremiah Useni against governor Simon Bako Lalong, there may came an era where anybody can pick -up another person’s certificate like picking the certificate of Chief Mike Ozekhome by going to swear to an affidavit, although the certificate bearing Ozekhome that Mukalia Ozekhome, Michel Ozekhome, we will be in a dangerous politics if we should allow that to happen.

This is one case the intermediate court, the court of appeal should put its leg down and up hold section (138)of the constitution which showed that the grounds of qualification are both “Pre and Post election matter “,that the Supreme Court never held that they are pre election matter only

They were citing one or more less over (20) twenty cases in one of the judgement ,both of them post election that was the main judgement decision of the court in this case.

The main decision of the Supreme Court on Atiku Vs Buhari which spans over One Hundred pages ,never ,ever said qualification is a pre- election matter is both Pre and Post election matter.

The three authorities I give the Court during the hearing today and summit to the Court, is not “Concurring but Decenting “,because concurring judgment cannot go separate from the main judgement.

We have be able to distinguish from the two, we believe that this is the particular case for this tribunal to hold that Gen. J.T Useni popularly, very fairly and credibly elected by the people of plateau State to be their governor from 2019-2023 and that popular mandate which presently in the custody of governor Bako Lalong should be retrieve and given back to Get. JT Useni because there could be no two Emirs , Ezes and Obas

in one palace.

The real Eze, Emir and Oba is Gen. Jeremiah Timbut Useni.

By, Giwa Alex, jos

Member representing Jos North-North in the Plateau State House of Assembly Hon. Baba Hassan has again triumph in the appeal tribunal.

As the Court of Appeal setting in Jos, plateau State capital has upheld the election of the three times member of the Plateau State House of Assembly ,Hon. Ibrahim Baba Hassan, of the All Progressives Congress (APC) into the seat of Jos North- North State Constituency in Plateau State House of Assembly.

The presiding judge, Justice Moses Ugor, held that the appellant failed to proved their allegation that Hon. Hassan has forged a Diploma certificate he presented to INEC to contest the 2015 House of Assembly election.

Barr. Munir Barau, of the People’s Democratic Party (PDP), had challenged the 2019 election of Hon. Hassan, alleging that he had presented false information to INEC by presenting, ”forged Diploma certificate from University of Jos.”

However, the trial tribunal held that Barau, did not proved his allegation beyond reasonable doubt and the tribunal held the election of Baba Hassan.

But Barau not satisfied with the judgement, appealed the matter.

The appeal court held that the lower tribunal is right to have struck out Barau’s, exhibits P7, P8 and P10, and issues 1 and 2 of his petition, having not tendered certified true documents.

Justice Ugor, further held that the tribunal was right when it held that PW2 the deputy registrar of the University of Jos, only gave an oral evidence, rather than documentary evidence.

The court held that Barau, has failed to proved his allegation beyond reasonable doubt, as required by sections 131, 132 and 133 of the evidence act.

And further held that the 2nd respondent has presented exhibits R2 being a letter signed by the registrar of the University certifying the Diploma certificate was genuinely obtained from the University, adding that Hon. Hassan has also presented a Police witness that tendered an investigation report, which also confirmed the Diploma certificate was genuine.

Justice Ugor, further held that the 2nd respondent has presented Leadership Newspaper publication from the University also confirming the eligibility of the certificate

He hed that the appellant did not presented the registrar to disapproved his signatures on all evidences presented by Hon. Hassan.

He said the issue of an alleged criminal suit pending before Federal High Court, canvassed by the appellant was; “not an issue at all.”

The court held that it resolved all issues in favour of the respondent, it upheld the judgement of the trial tribunal and further held that; “the 2nd respondent was not found to have forged the Diploma certificate and that his election is upheld.”

Hon. Baba Hassan has won the 2019 election with 41,990 votes, while Barr. Munir Barau, won 13, 383, in 3rd place.

APC Should Apologize To Nigeria For Renegade On  Promises, Instead Of Pursuing Hate Speech Bill……… APC Chieftain

By,Our Reporter

The All Progressive Congress (APC) been advised to apologize to the people of Nigeria for the party inability to fulfill its electoral promises to the Nigeria citizens and stop pursuing “Hate”proposing death sentence for offender.

As there is no smoke without fire,

“If the millions of Nigerian youths can have something doing to earn a living, they will not have time for hate speech.

“if people are allowed to elect their leaders in a free and fair election there will be no hate speech.

“So, something gave birth to hate speech and that is what the Senate should address.

The APC chieftain also advised the 9th Assembly to also propose a bill that will apply for lands in the 36 states, including the Federal Capital Territory, Abuja as did for Ruga to be used as cemetery for hate speech offenders that will be killed.

According to Vatsa:

“I call on Senator Aliyu Sabi Abdullahi the proponet of “Hate “bill to also propose a bill that will ensure we have separate cemetery for offenders so that we can have it as tourist’s sites with inscriptions ‘Hate Speech’ cemetery because the offenders may also include those of us who have benefitted from hate speech.

“What a shame.”

Vatsa wondered why the APC-controlled Senate should ever contemplate such a “draconian and unpopular law,” saying: “We rode to power in 2015 through hate speech.

“If the Senate is proposing death penalty for hate speech, then what will they do to Boko Haram, armed bandits, kidnappers, oil bunkers and treasury looters both politicians and civil servants”?

“Throughout the length and breadth of the nominal complainant’s evidence, he never linked the 2nd Accused person (Dr. Odeh) with the alleged diversion of funds from Choco Condiments Nig. Ltd.
“To further show that this Count of Conspiracy, just like all the other Counts proffered against the 2nd Accused person (Dr. Odeh), are just based solely on the figments of the PW13’s imagination and baseless suspicion, PW6, who is one of the IPO in his evidence”.
However, Hon. Justice Longji, in his Ruling, dated 7th November, 2019, held that, “A No Case Submission may be upheld where:-
a. There is no evidence to prove an essential element of the alleged offence.
b. The evidence adduced has been so discredited as a result of cross-examination, and
c. The evidence is so manifestly unreliable that no reasonable Tribunal or Court can safely convict.
In the case of TANGO vs. C.O.P (2007) 12 NWLR (part 2049) p-the Supreme Court held thus:
“Therefore when a submission of no prima facie case is made on behalf of an accused person the trial court is not thereby called upon at that stage to express any opinion on the evidence before it. The Court is only called upon to take note to rule accordingly that there is before the Court no legally admissible evidence linking the accused person with the commission of the offence with which he is charged”.
And in the case of Okafor vs. State (2016) LPELR—26064 (SC) Sanusi JSC had this to say:
It also must be pointed out at the stage of “No Case Submission” is made, all that the trial Court is supposed to consider is not whether the evidence so far adduced by the Prosecution is sufficient to justify conviction but simply whether the prosecution has made out a prima facie case requiring some explanation from the accused person as regards his conduct or otherwise.

“Accordingly, it is my holding that Counts l, ll, lll, lV, Vl and Vll of the charge no prima facie case had made out to warrant him (Dr. Odeh) to be called to enter his defence.

From the Ruling of the Court dated 07/11/2019 obtained by REALITY, it is expected that his Bank Accounts would be made active, wherever they may be domiciled.

Kogi State University Renamed After Prince Abubakar Audu.

By, Our Reporter

The state owned university, kogi state university has been renamed after the former governor of the State and political sage Prince Abubakar Audu.

As the political followers of Audu ,under the auspices of Abubakar Audu political family expresses their gratitude to the sitting governor of Kogi state, Yahaya Bello for keeping the name of the late political sage alive by naming the state citadel of learning after him.

In a statement jointly signed by the spokesman of the Audu political family, Dr. Odekina Abutu and Chief David Dare Olatunde, the Maiyegun of Isanlu and made available to journalists in Jos on Sunday, the biological and political family fulsomely thank the governor for his kind gesture and applaud his courage and wisdom which led him to so doing.

In the same vein, the Audu family urges the public to translate the event as nothing but a kind gesture of goodwill from the Governor.

The statement reads:

“The Audu biological and political family express their profound gratitude to His Excellency, Governor Yahaya Bello for the honor done to our late leader. It is a gesture that no doubt, gladdens our hearts.

“The late Prince Abubakar Audu was a leader who never relented on his quest to bring excellence to Kogi State. His was a great service to us all and immortalising his name is a right step in the right direction by Governor Bello.

As regards the whisperings going on in certain quarters, renaming of Kogi State University (KSU) to Prince Abubakar Abubakar University (PAAU), we wish to make it clear that it is not a political event, neither is it couched in a political charade. It is a profound kind gesture aimed at extending honor to whom it is due, or in this case, immortalization to whom it is deserving of it.

“We beseech our people not to give it unintended undertones in a bid to push distorted narratives and remove from the lustre of the occasion. Governor Yahaya Bello renamed the university out of his own volition in good faith, and not to seek political favours.

“Our late leader deserves this honor and more for his humongous and incredible service to our beloved state. Those who see and contend otherwise are just playing the ostrich. We should not interpret every occasion as mere politics simply because politicians are involved. Renaming KSU to PAAU is a serious event that should not be politicized but appreciated as such. A gesture of goodwill may cost very little, but its true value can be incalculable.

“By and large, we implore you all to please, out of respect for our late leader and hero, desist and cease from running political commentaries regarding the renaming of the state’s institution by the governor”, the statement reads.

The Audu biological and political family opined they remain eternally appreciative of governor Yahaya Bello’s immense goodwill gesture, adding that it is an august phenomenon that will not be forgotten in a hurry.

Berom People Of Plateau State  Disown Sen. I. D Gyang,Call For Explanation .

By, Giwa Alex, jos
Senator Representing Jos North District at the National Assembly Senator I.D Gyang has been disown buy his kinsmen as they call for explanation.
This is over statement Accredited to him that the senator has gone to apologize to the Fulani to forgive the Berom in what ever way they most have offended them.
In a press statement held on 8th Nov, 2019 in Jos, the plateau state capital , sign by it Chairman Mr.David Choji and it Secretary Pam Marku said the action of the Berom born Senator did not represent the the thought of the Berom nation on the the plateau an Nigeria as whole.
“This briefing is of two folds want to state here and now that, his action and utterance came as a shock and very embarrassing to us, as we never gave him such mandate in the conflict circle, to delve into the debacle between the Berom people and the Hausa Fulani.”
“We want to state that, Sen. I. D. Gyang, cannot be our spokesman at that level, when we still have occupants of our Traditional stools, Socio-cultural groups alive and our people Internally Displaced as Internally Displaced Persons (IDPs) still exist and displaced from their ancestral homes.”
“We therefore, want to use this Press Brief to dissociate the Berom people from his politically packaged forgiveness exercise that was consummated at his residence in the just celebrated Sallah.”
They said the apology of the Senator is not only wrong, but at the same time untimely.
“Secondly, with the utterance of the National President of Miyetti Allah Kautal Hore Socio-cultural organization, Abdullahi Bodejo, saying that, there was no basis for Fulani Herdsmen to apologize to Governor Samuel Ortom, over alleged killings of Benue people.”
As the group call the Senator apology absurd when the Fulani themselves said they will never stoop low to apologize to anybody
“Stating and I quote that, “I am the National President of the Miyetti Allah Kautal Hore, I didn’t apologize to anybody; our organization didn’t apologize to anybody because, Fulani Herdsmen didn’t kill or hasn’t killed anybody. I was surprised where journalists got that story. Maybe, the journalists wanted story to sell their papers. It is fake news!”
The group however use the medium to send strong warning to I.D Gyang,
“We, as Berom people, want to also use this Press Brief to call on Sen. I.D. Gyang to reframe from representing the Berom people in such capacity and follow the basic Principles of Democracy.”
“Even at that level, he should also realize that he is not the political leader of the Berom.
Based on the Fulani National President’s revelation above, we use this medium to call on Sen. I.D. Gyang to tender an unreserved apology to the Berom People and the entire Plateau people now, as the forgiveness package meant to deceive the people has crumbled in the face of TRUTH”.
“Furthermore, we call on Sen. I.D Gyang, to tell the people of Plateau State of what has gone wrong with the Political Son and Fatherly relationship between him and the former governor of the State, Sen. Jonah David Jang, his Boss, while he served as Permanent Secretary Security.”
“We also want to know, why, Sen. Gyang is celebrating and touring around the state, with some alleged political foes, antagonists of Jonah Jang’s immediate past administration, close rivals and opponents to his political interest for the Berom and appointing them as Special Assistants, while his former Boss, Sen. Jang is been prosecuted by the Economic and Financial Crimes Commission (EFCC) at the Plateau State High Court in Jos.”
“In addition, we want to also submit that we are aware that there are already appeals flying out of the Plateau State High Court, presided over by Hon. Justice Daniel Longji, to the Court of Appeal concerning some of his rulings in the on-going trial of Sen. Jonah Jang. We can also observe desperate moves by several people to see that the Senator is jailed over the allegations made by the EFCC hence, the Amended Charge recently filed by the EFCC.”
On this note, we wish to inform the general public that we have directed our legal team and members to look into our findings and see what can be legally done, to address these perceived plans, which some of our Sons and Daughters are also involves in.
In another development the body use the medium to announce the forth coming “Wusal Berom”.
“First, we want to use this briefing to inform our members and the entire world through you that, the Beroms would be celebrating their Annual Thanks Giving Service and Prayer Day called “WUSAL BEROM”, which is slated for this coming Sunday, being the 10th day of November, 2019, at Vwei (Mararaban Jama’a) Open Arena, Jos Plateau State.
“Berom Sons and Daughters are expected to grace the occasion from far and near. But, mostly expected to grace and pull dn the Grace of God on this occasion are those of us, who dwell within Berom villages, towns and Local Government Areas (LGAs) of Plateau State and its environs.”
“This renowned occasion, known to all as WUSAL BEROM, started in 1993, when our great fathers initiated and established it to cause a strong unity among Berom people, irrespective of their religious or political leanings.”

Breaking:America Dollars  Is At The Verge Of Collapse As Nigeria Sign Currency  Swap Deal With  Republic of China.

By, Giwa Alex, jos.
Nigeria just be out if bondage as the American dollar is at the verge of collapse, and may no longer be the only be the only currency to determine international trade.
This is as the Central Bank Of Nigeria has finally sign currency swap with the Republic of China for ease of doing business.
What this means is that all the business transactions hitherto carried out even in China using dollars will no longer be so as China currency will now be use instead of the hitherto “Almighty” America dollars .
The implications of this new deal with China government is that all the goods been bought with dollars even in China market will now be purchased with China currency which automatically reduce the price of goods and services due to low exchange rate of Chinese currency compare to America dollar which is on a high side.
The importance of this is that since almost 70% of the goods we import come from China and Asia and 12% America why must we use Dollars to transact with China? from now instead of using dollars at N350 to 1dollar to import those goods, we can now buy Yuan at 47 naira to 1 Yuan and import those stuffs directly.”
” Soon you will be buying that techno phone you bought at N80,000 for N12,000.”
“Instead of buying these goods in dollars in China, we will now buy them in Yuan which is 5times cheaper than dollars.”

yy

” A giant stride against Nigerian looters who will not want it to be reported or allow end-users to understand this victory over supremacy of dollars in our daily lives and economic activities.”
Up coming reality is that from days to come try and monitor exchange rate.
“Some of those people who hoarded foreign currencies to make gains will off load them in order not to have heart attack over their huge loss arising from the currency swap deal with china.”
“Dollars and pounds will flood everywhere with no buyers, as the buyers will draw naira from their accounts in banks with presence in China.”

6.5 Billion Money Laundering Case, Jonah Jang Call For Re-Cross Examination  Of Prosecution Witnesses.

By, Giwa Alex, jos

Senator Jang 6.5 billion money laundering case has taken a new dramatic twist as the immediate past governor of plateau state Senator David Jonah Jang has call for all the prosecution witnesses to be re-cross examined.

Speaking through his counsel Edward Pwajok (SAN),said the re-cross examination of the prosecution witnesses is very imperative to illicit more information from them on the area of the new amended charges.

But what would have be another smart move by the Economic and Financial Crimes Commission(EFCC),objected to the application of the 1st respondent Jonah jang for all the prosecution witnesses to be recall for re -cross examination.

The counsel to the 1st defendant Edward Pwajok (SAN), argued that the reasons is predicated on the amended charges which touches the entire gamut of the case including the Federal government of Nigeria and the apex financial institution of the country, the Central Bank of Nigeria (CBN) and for fair hearing it would be nice for all the witnesses to be recall for re-cross examination.

After argument and counter argument, justice Longji rule that since the new amended charges touches the entire gamut aspect of the case, it would be wise for the interest of justice for all the prosecution witnesses to be re -cross examined to cover the new areas thrown up by the new amended charges by the prosecutor.

Pwajok maintained that the team of lawyers to David Jonah jang head by the legal luminary Mike Ozekhome (SAN) will study the amended charges against the 1st defendant Jonah jang, and possiblel

y. challenge it at the appeal court, as the charges which is tag “Approval and Transfer”is not know in law.

The case has been adjourned to Oct, 30th, 31st and 1st of Nov, 2019 for the re- cross examination of the prosecution witnesses.

It would be recall that in the last adjournment ,sitting Sept, 30th, 2019 the Economic and Financial Crimes Commission (EFCC)come up with an application to amend some of the charges 1 to 17,probably because they were no longer comfortable with the way the case is moving contrary to their expectations.

The “Approval And Transfer”,

the 1st defendant Jonah Jang through his counsel Edward Pwajok (SAN) vehemently opposed the application on the ground that the phrase is not know in law, and if it allow to scale through, it would amount to making caricature of judicial process.

The 1st defendant further added that the application will amount to embarrassing his client who is the 1st defendant, and cited various authorities to support his argument.

In his ruling on the application, justice longji hold that the application can not in any way embarrass the 1st defendant as insinuated by the counsel to the 1st defendant, as the case is already on the public domain, and however ruled in favor of the prosecutor for the amendment of the charges.

In what could be best describe as in quick succession, the 1st defendant through his counsel Edward Pwajok (SAN) move to apply that the court should rule that all the prosecution witnesses earlier cross examined should be presented for re- cross examination.

The application was however granted on the ground that the amended charges has summersault the whole charges so the need for all the prosecution witnesses to be re-cross examine.

The 2nd defendant who is not opportune to be join in the amended charges despite some of the amended charges affect his client Yakubu Pam threaten to challenge it in the appeal court.

The counsel to the 2nd defendant Oguntuyi said the amended charges 9,10,11and 12 directly affect my client ,closing us out is against our fundamental human right to fair hearing we shall study it carefully with the view to know the next line of action to take.

The case had been adjourned to Oct, 30th, 31st and 1st Nov, 2019 for re-cross examination of the prosecution witnesses.

Prof.Mailafia Oral Application To Stop Journalists Reporting His Case Against Masara Kim Failed.

By,Giwa Alex, Jos

Prof. Mailafia oral application urging the court to ban journalists from reporting the court case between him and one Mr Masara Kim has been over rule by the judge.

The oral application of professor Mailafia represented by his counsel A.A Abrahim is predicated on the ground that the continue reportage help to expose the content of the case instead of playing it down which is helping to add salt to injury.

The judge was quick to disagree with the plaintiff counsel on the ground that journalists aside having beats which court is one, have unique way which they write to communicate to there larger audience /readers.

In his response, the defendant counsel replied that he would only respond to the plaintiff’s Counsel if he present a written application on the matter.

Plaintiff’s Counsel, Barr. A. A Ibrahim who is handling a Defamation Case between Prof. Dimis Mailafiya against Masara Kim Usman, Tue 8th, Oct, 2019 was visibly unhelpful in his misgivings against Journalists reporting court proceedings.

Prof. Dimis Mailafiya, the Director General of the Plateau PDP Gubernatorial Campaign Council, in the 2019 election had early this year filed defamation charges against a Jos based Journalist, Masara Kim, demanding about N50 million damages.

Kim, according to our findings has been dragged to court in January 2019, over a news report he published on his news blog, http://www.masarakimsblog.com in October 2018, wherein the Sen. Jeremiah Useni’s campaign DG was accused of allegedly collecting bribe to shortchange and back a supposedly unpopular running mate for his boss.

When the matter came up for hearing, Kim and his team of Lawyers head by Nanle Komak from Komak Law firm appeared in the court alongside counsels to the plaintiff Barr. A. A Ibrahim to proceed on the matter.

But with surprises, the defendant’s applicant Counsel, Barr. Komak moved to file an application for a motion on notice for the extension of time to enable the Defendant file his statement of defense.

The application was not opposed by the plaintiff Counsel, Barr. A. A. Ibrahim, making the proceedings Judge to fix January 27th 2020 for the continuation of hearing.

The defendant had in a statement of defence through his counsel in January 2019 filed a motion seeking to strike out the case as well as filed a followup to a memorandum of appearance filed in May 2019,

The defendant was issued a notice of intention to go to court in November 2018 by Prof. Mailafiya’s Councils, M.Y Saleh (SAN) & Co law firm.

At the expiration of the grace period within which the said defamatory news story was expected to be retracted, Kim was served a writ of summons in January 2019.

The University of Jos Professor of Economics is demanding a N50,000,000.00 relief for the offense, a retraction and an order restraining the Publisher of http://www.mkreporters.media from publishing any further ‘defamatory’ story against him.

Kim is however contending that the news report in question is not assertive and was published with no ill-will after offering a chance for defence which was not exploited by the complainant.

$2.5billion Loan, Nigeria Move Against President Buhari .

By, Giwa Alex, jos
Nigeria is set to be on a cross part with the All progressive Congress (APC)led by president Mohammadu Buhari government as the Nigerians in diaspora has petition World financial body World Bank to stop granting any further loan to the country.
As the online petition is currently ongoing, the group plans to embark on a peaceful protest march to the headquarters of the World Bank in Washington on 15th Oct,2019
Nigerians in diaspora under the auspices of “Global Coalition for Security and Democracy in Nigeria” have petitioned the President of the World Bank, David Malpass, to put a stop to further negotiations withthe President Muhammadu Buhari regime to borrow another $2.5 billion.
The group stated that Nigerians are tired and can no longer tolerate the action of government officials that steal public funds and resort to borrowing
and increased taxation against the same citizens they stole from.
In a letter exclusively made available to SaharaReporters and cull by this medium,
Global Coordinator of the group, Frederick Odorige,15 reasons were

listed why the loan should not be approved.

“After writing off Nigeria’s $18 billion debt by the Paris Club in
2005 the Nigerian government went on a borrowing spree which has led
to a current debt of over $81 billion that was mostly mismanaged.
“Some persons that were indicted for various corruption cases have
been appointed by the current governments as Ministers. These are the
same persons that will manage the anticipated fund.
“Our federal legislators continue to earn the highest salaries in the
world insensitive to the fact that we are currently the poverty
capital of the world. The senators are also shopping for about $17
million to buy vehicles in addition to their fleet of cars,” the group
explained.
It added that senators traditionally ‘pad’ the country’s budgets for
their selfish interests.
In 2018 a court ordered President Buhari to prosecute the senators
that padded 2016 national budgets by N481 billion (about $1.5
billion).
The group, however, noted: “The President intentionally refused to
comply with the court order. The padded and stolen amount is enough to
build 10 standard hospitals in each of the 36 states of Nigeria.
“We have 34 mineral resources spread across 430 locations in Nigeria.
Many developed countries do not have this. If for many years, our
government cannot harness these resources to enhance our commonwealth,
then they should be left to their shame.
“We are very convinced that at least half of the anticipated loan will
either be stolen or used to service the unnecessary high cost of
governance. We have been ranked 144 out of 180 countries in terms of
transparency.”
Arguing further, the group said: “The current government of retired
General Muhammadu Buhari claimed to have bought mosquito nets for $16
million which they purportedly distributed. That money was also
borrowed. No clear accountability was done as our children continue to
die daily from malaria. For every dollar you give as further loans,
you speed the death of Nigerian children and facilitates in mortgaging
the life of our present youths.
“The United Nations has projected that Nigeria will remain the poverty
capital of the world beyond 2050. This is an attestation to the fact
that there are no clear and concrete development plans to lift our
people out of poverty. It is no longer news that our people are
escaping in droves from the country and forming the highest number of
African migrants that die on the Mediterranean Sea.”
In October 2018, the International Monetary Fund (IMF) warned Nigeria
and sub-Saharan African economies to check the rising levels of debts
and to diversify their revenue bases or face a crisis.
Other financial institutions in Nigeria have also warned the
government against further borrowing.
“Nigeria has refused to comply as it continues to depend on the
fluctuating oil prices. Economic crises will surely be quickened if
you issue this loan.
“Sadly, our country`s debt servicing to revenue ratio is now more than
50 percent. This percentage will increase as you continue to grant
loans and it will be practically impossible to ensure development.
“Since most of our resources are stolen by those in government, the
burden of taxation are always be passed to the general public. For
example, VAT has just been increased from 5 to 7.2%, including the
introduction of other bank service charges,” it pointed out.
Future governments, the group stated, might find it difficult to pay
back what the World Bank intended to lend Nigeria unless the bank was
prepared to write off the loans in the future.
It also cited insecurity in various parts of the country and the
inability of the government to provide stable electricity which has
further compounded the challenges of production as a reason the loan
should not be given.
“This will be worsened as the unemployment rate will jump to 33.5% in
the year 2020,” the group claimed.
“Many states in Nigeria are currently struggling to pay salaries and
the minimum wage which is barely $84monthly. This is as a result of
the fact that former State governors stole so much money and left
their various states in huge debts. For example, Kogi State of Nigeria
currently owes 39 months salary arrears to its 7000 teachers. The
story is almost the same in some other states.
“There are various lawful revolution protests going on in and outside
Nigeria as our citizens have risen from complacence to challenge the
incompetencies of government. Such protests have led to the use of
violent force by security agencies who have detained, shot and killed
unarmed protesters against the rule of law. For any money you lend to
the Nigerian government, you are unwittingly investing in the blood of
our people.”

On the comparison of the two different certificate of the 2rd respondent Baba Hassan to the one he obtained at the university of Jos and that of the one of the National Open University of Nigeria, where one is said to be carrying seal while the other is not, the tribunal held that there is no bases for comparison as the law which set up the two institutions are different,as comparing the two on the bases of features contain there in we amount to ambiguity.

Political Stalemate Between President Buhari And Bola Tinubu Deepen.

By, Giwa Alex, jos

The political stale mate between President Mohammadu Buhari led All progressive Congress (APC)and the party Bigwig Asiwaju Bola Ahmed Tinubu has taken political dramatic turn as Tinubu is making ground plans to abandon the party.
The decision of the former governor of Lagos state Tinubu according to filler may not be unconnected with gradual removal of the Jaganban’s boy hitherto holding sensitive positions in the APC government.
The recent straw that break the political head of Tinubu is the dropping of the VC president Osibanjo as the leader of the Economic Team who is one of the loyal boys to Tinubu.
The action he considered not only an insult but political joke taken too far by the president and the cabal who have practically hijack Mr President and the entire activities of governance in “Aso Rock” the nation seat of power.
The open confrontation against members of the former governor of Lagos State, Asiwaju Bola Ahmed Tinubu political circle has taken another ugly dimension with the latest onslaught on the former Attorney General of Lagos State, now Vice President, Professor Yemi Osinbajo by the members of the Aso Rock cabal.
The workings in the Presidency is that, the Vice President should be the head of economic team, Osinbajo was in charge of Economic Management Team (EMT) but the latest development shows that he has been relieved of this duty with the composition of another Economic Advisory Council (EAC), by President Buhari, which has former CBN governor, Prof. Soludo and others as members, headed by a former University of Lagos don, Professor Doyin Salami.
To further the Osinbajo’s ordeal, the Special Presidential investigation panel for the recovery of public properties set up by the VC president in August 2017 was dismantled, with Presidential directive that all the report done so far should be handed to Minister for Justice, Abubakar Malami.
There was an accusation that Osinbajo deliberately most of the time ignore the approval of President Buhari before embarking on some policies in agencies assigned to him, this allegation was refuted in a press statement issued by his media aide, Laolu Akande, who absolved vice president of any wrong doing, according to him, he claimed that Osinbajo cannot embark on any policy without getting the Presidential nod.
We also learnt that the former boss at Lagos Internal Revenue Service (LIRS) now the head of FIRS, Mr Babatunde Fowler who was reportedly nominated by Bola Tinubu is about to be kicked out, already there is a memo from the office of the Secretary to the Government of the Federation, Boss Mustapha directing Fowler to hand over to the permanent secretary, which make is obvious that his tenure may not be renewed, making him to be another casualty in the ongoing tussle between Lagos and Abuja cabal.
The job of many of Tinubu’s political followers in the Federal level are threatened due to the political war some persons believed to be close to President Buhari are waging against him in relation to the 2023 Federal elections.

By, Giwa Alex, Jos

The Plateau State House of Assembly ,(PLHA) Election Tribunal sitting in Jos the plateau state capital has on Thursday 19th Sept, 2019 upholds the victory of Member Representing Mikang Constituency the Majority Leader ,Hon. Daniel Jonathan Naanlong of the All Progressive Congress, (APC) , for lack of merits and the failure of the petitioners to proof his case beyond reasonable doubt .

The petitioners ,People Democratic Party, (PDP) Hon. Theophilus has challenged that the election held on the 9th March ,2019 which INEC declare Naanlong as the winner was full of irregularities ,mutilation ,over voting ,corrupt practices .

He was seeking an interim order of the tribunal to quash the election and declare him winner having scored the highest number of vote cast .

He urged the tribunal to nullify and order for rerun in 10 polling units into the office of the State House of Assembly Mikang constituency which was filed on 18th April, 2019.

The judgement explained that the witness parades by PDP, and the candidate in 9th March ,2019 their statement on oath are incompetent and lack facts or proof of evidence weren’t supported with grounds in contention specific that petition most clearly show that no merits.

According to the judgment ,the candidate failed completely to proof the issued of over voting ,fortifications ,alterations of result which made the entire petition invalid and can’t meet up the electoral act .

The reliefs sought by the PDP and her candidate didn’t adequately supported the paragraph 4.1b of the electoral act so the allegations brought by the PDP is not the business of the tribunal to focus her mind on the error of the respondents.

The judgment can’t digest the petitioners area of conflict generally on six grounds of the 1,2&3 respondents that the tribunal lack the jurisdiction that fact of the petition didn’t support ground base on standard of the electoral act .

The 1,2&3 respondents argued that the petition lack grounds and had abandoned his petition on abuse of electoral process with statement of PW1,PW2 were expunged from the records.

They order that this honourable tribunal should strike out the petitioners petition for he has failed to satisfy the requirements due to incompetent because all witness statements on oath were accordance to the mandatory of the court in section 138(1b) of the electoral act.

The tribunal ruled all parties are allow to ventilate their cases on the side of merit going by the guideline of conduct of the exercise in compliance with section 13 of the electoral act.

The judges stroke out that the petition had failed to meet up the credibility of the petition especially the issued of over voting fortifications, cancellation of results and the alleged non use of smart card readers which malfunction in March and without voters registers .

However, about 8 witness parades by the petitioners and 13 documents were the first respondent, didn’t present witness and 2nd respondent had one with 3rd respondent two respectively.

Responding to the judgment ,Hon Naanlong Jonathan Daniel commended the tribunal for upholding the victory which is the mandate of people of Mikang constituency .

He urged the people of constituent to expect more dividends of democracy with victory obtain today sky is the limit .

Daniel called on politician to imbibe the culture of sportsmanship and tolerance one another for democracy to grow because the resources use for the pursue of litigation should have be channel for the development of Mikang Constituency .

Ozekhome Expose Ploy To Sown Seed Of Disagreement Amongst Jonah Jang’s Counsel .

By,Giwa Alex,Jos

Mike Ozekhome(SAN)has raise alarm over some people which cannot be distance from the ruling government of All Progressive Congress(APC)are on desperate ploy to cause disagreement and sown seed of discord amongst the counsels of jonah David Jang .

As they have move ahead circulating fake news that him Chief Mike Ozekhome disown his colleague one Mr Oguntuyi in court during the trial of the immediate former governor of plateau state Dr. Jonah David jang who is currently facing trial on money laundering by Economic and Financial Crime Commission at the plateau State High Court sitting in jos.

In a statement signed by Chief Mike Ozekhome and made available to our correspondent in Jos,plateau state capital, Ozekhome said the news is force and infringement of the imagination of the author Mr Uwujaren the spokes person of Economic and Financial Crime Commission (EfCC) and said the publication is

“Lies From The The Pit Of Hell “.

The legal luminary who is the counsel to jonah jang in money laundering trial and the 1st respondents in the case lamented that Mr Uwujaren was not even in Court during the proceeding but relied on hear say.

And further add that is this coming at a time when the APC led government is crying woo on “Fake News and Hate Speech “

Ozekhome stress that Oguntuyi and myself who is representing the 2nd respondent Yakubu Pam,they are working together to obtain justice for their clients which is evidence indicate they are being witch hunt.

For the purpose of clarity and record he said ,my attention has just been drawn to a trending story in which I was quoted as allegedly disowning one brilliant Mr S.A.Oguntuyi,counsel for Yusuf Pam,the second defendant in a case in which the EFCC (as FRN ) jointly charged ex governor of Plateau State,David Jonah Jang and the said Pam to a High Court in Jos over alleged fraud.

“The statement credited to the EFCC spokesman,Mr Wilson Uwujaren I had expected him to deny and disown this warped report of today’s court proceedings in Jos,Plateau State) alleged that I disowned S.A.Oguntuyi’s line of cross examination on behalf of the second defendant,Mr Yusuf Pam.”

With due respect, this is a “Dirty Lie from the Pit of Hell”.

Nothing of the sort happened.

Indeed, what took place as recorded by the court was the exact opposite of the issue of lies Mr Uwujaren, who was not physically present in court, was fed with. The facts are as follows:

“I was privately prompting and professionally corroborating with Mr Oguntuyi, who was doing a marvelous job of effectively demolishing like a pack of cards, after I had finished mine the issue of outlandish lies told to the court by the EFCC witness,Mr Musa Sunday,in this joint trial.Mr Rotimi Jacob’s,SAN,counsel to the EFCC took objection,on the ground that the second defendant,Mr Pam,on whose behalf Mr Oguntuyi was cross examining Musa, was not my client”.

He wondered why I should be involved in helping in the cross examination on behalf of the 2nd defendant, since he was not my client.I promptly rose up and told the presiding Judge, the honourable Justice Daniel Longji, that the trial is a joint one, with 10 out of the 12 counts involving Jang and Pam together.I submitted that the two defendants would therefore swim or sink together.

The Judge ruled in my favour that I was entitled to be involved in the cross examination. He had made a similar ruling in our favour when the prosecution counsel had also objected to our cross examining EFCC witnesses during a trial-within-trial of Mr Pam,the second defendant. It is unfortunate that the entire happening on this point was grossly misrepresented. The court records which are public documents are there for anyone to view.

I never at any point in time rose up to say “I urge the Judge to dismiss this line of questioning as it only further supports the investigation made by the EFCC and we are washing our hands off this mediocrity. If the documents are there, why are u simply beating about the bush for hours on end….at this point we ( the course for the first defendant) dissociate ourselves from this line of questioning during cross examination by the second defendant”.

“It is clear to me that Mr Uwujaren was grossly misled by fake report from his media representatives in court who probably desire to keep their jobs”.

Rather, what I said with a chuckle, was that the witness was wasting precious time and Mr Oguntuyi shouldn’t bother dignifying him in the witness’s vain attempt to use oral evidence to garnish and vary written documents already admitted as exhibits before the court, since such oral evidence was of no moment.Even attempts made by the prosecution counsel to prevent many damaging questions during the hot cross examination were rebuffed by Mr Oguntuyi and myself, who insisted that the witnesses, having finished their examination in Chief should not be shielded from the fire of cross examination. The Judge also ruled in our favour and told Mr Oguntuyi to continue. The entire reportage as signed by Mr Uwujaren is therefore greatly skewed and loaded with outright brazen lies which are not supported by the recorded proceedings of the court.

“Mr Uwujaren credited me with saying,”for lack of a better word, the Judge must conclude the judgement on this case before his retirement by ending 2019 on a trial denovo”.This statement was deliberately taken out of the context in which I made it.It was when the issue of adjournment came up and the Judge told all counsel in court that he would be retiring at the end of the year and so must conclude all matters before him, including this particular trial before retiring.I Immediately got up and supported the position of trial Judge”.

I submitted that on our part,we are ready, willing and would all within our powers to ensure the trial is concluded before he retires. The reasons I gave were two-fold:a.I would not want the trial to start all over de novo before another Judge were the present Judge to retire without concluding the case.b.The journey between Abuja and Jos is quite perilous, since there are no flights, and I would not personally,at my age, want the continued frequent journeys by road between Abuja and Jos.How this altruistic statement which the presiding Judge praised, could be yanked out of context and added to my alleged (but false) disagreement with Mr Oguntuyi, beats my imagination.”

My humble piece of advice:

” let the court decide whether on the facts so far presented to the court, the EFCC has been able to present any credible criminal case against Jang and Pam.Its case cannot be helped or salvaged by deliberately twisted and slanted reports anchored on tissues of lies and spawned fairy stories of alleged events that never took place in the open court.Such reports cannot substitute for the dismal outing by its witnesses so far recorded before the court”.

Chief Mike Ozekhome (SAN) has give reasons while they are heading to Supreme Court to challenge the presidential election tribunal that give victory to Mohammadu Buhari.

He said the appeal court final verdict will go a long way to address the obvious lapses of the Election Tribunal which they fail hitherto to put into consideration during the verdict.

The legal luminary said the court of appeal is a litmus test for the independent of the judiciary whether they have been cajoled by the execution.

Ozekheome(SAN) was speaking in an interview with journalist in jos the plateau state capital 13th Aug,2019.

“I want to hear the final say by the supreme court.”

The presidential election tribunal is people by people draw from the court of Appeal,is an intermediate court of law.”
“I would prefer to wait for the decision by the supreme court before making up my mind whether the Nigeria judiciary has finally be cajoled and intimidated by the executive to toll it bidding forever.”
The reason is that ,its the decision of the supreme court that would count ,but for now,l can confidently say that the case was poorly decided by the Presidential Election Tribunal.
He said the election tribunal is grossly poor evaluation of evidence.
“There was a very poor evaluation of evidence, there was cases and instances where evidence of the respondent that is INEC and Buhari where considered , without considering that of Atiku Abubakar and PDP been considered at all.”
There was misapplication of the provision of the constitution and electoral Act,the INEC guideline,INEC handbook ,provision relating to a server by INEC.
There was an instances the election tribunal behave like “Father Christmas”by given to the respondent who don’t even ask,
“for example, they where mainly saying Buhari was qualified to contest the presidential election, when the court came out to say Buhari is not only qualified but”Eminently” qualified.”
They were even granting to them more then they ask .
We are also concerned that if the judgement is not challenge, will set bad precedent for us in Nigeria in term of business dealings,Educational qualification , international ,international investment.
When you begin to say that all that matters is the surname Buhari, and doesn’t matter whether the surname is Mohammadu or Mohammed, then we are in trouble as a country.
“It means because l have Ozekhome, anybody can come tomorrow that my qualification belong to him even though the surname is Mukila or Mishel ,the fact that Ozekhome is the surname is enough to cover ,does not matter if your surname is Mukalia,Mulikat,Mishel,Angelo it doesn’t matter.”
If you then say it doesn’t matter,it means any body can attach certificate to Form (Cfoo1).
The form itself said attach the certificate if you said you have it.
The tribunal is saying it doesn’t matter ,you can just state that you have the qualification.
Which therefore means anyone can go to court disposed to affide ,they say produce the certificate that is a dangerous signal .
Chief Ozekhome further add that the case is going encourage corruption and destroy our educational quest.
“This case is going to encourage corruption ,destruction of our very fabric of our moral and ethical eptoes affination which going to school reading hard very vigorously ,and rigorously to processes a certificate may no longer important.”
“All that may be important is that you have gone to the court of law and sworn to af that you have so and so degree, when you are ask to produce it ,you say it doesn’t matter and refer to the case of Atiku Vs Buhari.”
“That is the danger ,that is while we are heading to the supreme court ,we went the supreme court to up turn the judgement of the presidential election tribunal.”

Ozekhome stress that democracy is not got on platter of gold as you most for it.

We want democracy to be given face, democracy is a struggle.

“Nobody should expect that people in power should be dislodge easily.”
“Everybody is not Goodluck Ebele Jonathan who made that prophetic statement ,that epong statement “That my ambition did not worth the blood of any Nigerian.”
There are some people you have to push out.
They could be tranny, absolutism and dictatorship even in democracy, Aduf Hitler pretended to be a democratic ,they where holding an election ,but is regarded in history as the the worst deadest dictatorship.
Saddam Hussin of Iraq was suppose to be a democrat, because they conduct elections ,is regarded as one of the most brutish dictator that ever live.
Nansegbe Eyedema of Togo was going for election is know as one of the greatest dictator in history.
Papador of Hati was going for an elections, was known as one of the worst dictator ever.
Mobutu Seseseko of Zaye was going for elections,it also know in history one of the brutish and deadest dictator that ever live.
So the fact that we say we have democracy ,is not itself evidence that we are actually practicing democracy.
As l always say that democracy is not one hundred meters dash race of Ben Johnson ,or Hossen Boat that you finish in thirty second ,is Amaranton race of resilience of competing contifugal or Centrafugal forces that is ever at play with dynamic society.
That is why we have to be patient to fight it according to the tenet of democracy to enable us widen, deepen, strengthen, deodorised the attitude and aplititude.

We still believe strongly that there are men of integrity whose conscience is the highest

authority in the Plateau State judiciary.

Our kind plea is to our father, the Executive Govemor of Plateau State Rt. Hon. Barr. Simon Bako Lalong, a quintessential Bar man, a grassroot emancipator and a large hearted democrat to prevail on Hon. Nanlok Amos Kpamim and the All Progressives Congress (APC) to accept the decision of the Plateau State Election Petition Appeal Tribunal which is the highest adjudicating body or apex court was regards local government elections in Plateau State, delivered on 9th July 2019 which declared and returbed Ubandoma Joshua Laven as the duly elected chairman of Langtang North Local Government Council by taking on the path of honour in discontinuing the certiorari proceedings instituted at the high court of justice Jos.

This is in view of the fact that election is only 3 medium; political party an emblem and; politics a means to an end for the common good of all and not for personal ego.

They thank the concerned youth for maintaining peace in the face of all provocation.

“We salute the good people of Langtang North Local Government Council for keeping the peace and not taking the law into their hands in this difficulties time.”

Dabo  Vs Maitalla,Tribunal Set To Deliver Judgement.

By,Giwa Alex, Jos

The National Assembly Election Petition Tribunal sitting in Jos the plateau state capital is set to deliver judgement on the matter between Jonathan Dabo of the people Democratic Party (PDP) and Hon. Maitalla Haruna of All progressives Congress (APC).

This is after all the parties involved in the case have adopt their final written addresses on Tuesday 27th August, 2019 .

The tribunal Chairman ,Justice N.T Ezeogwu , which made the declaration after listening to the parties in the matter, said that the day of the judgment would be communicated to them in due course.

Jonathan Dabo of the people Democratic Party (PDP) and the party are challenging Maitalla Haruna, APC and INEC over his (Haruna’s) victory at the March 9th NASS re-run elections at the Tribunal.

When the case came up on Tuesday 27th August 2019 for adoption of final written addresses, Haruna, through his counsel, Mr. Nantok Dashuwar, asked the Tribunal to dismiss Dabo’s petition for lack of merit.

Dashuwar argued, “that since the elections of Feb. 23rd 2019 was canceled by INEC following the disappearance of the original result sheet and a re-run was conducted in which the petitioners participated, they have no ground to challenge the victory of Haruna.”

“ Since it’s obvious before this tribunal that original result sheet was not found, where else do the petitioners expect your Lordship to find it and declare Dabo winner of the elections?

“I urge your Lordship to disregard the arguments and reliefs sought by the petitioners and dismiss the petition for lack of merit, “ Dashuar pleaded.

Also speaking , Mr U.O Heavens, Counsel to 1st Respondent, INEC, urged the Tribunal to dismiss the petition for lack of truth and merit.

.

Mr Leo Ebi, Counsel to APC, the 3rd Respondent, also asked the Tribunal to dismiss the petition on the ground that the petitioners have failed to prove their case beyond reasonable doubt.

“Even the result which the petitioners claim should be considered and Mr. Dabo be declared winner can’t be clearly read because it’s mutilated and not readable nor has INEC stamp on it.

“After all they took part in the re-run of March 9th, therefore, they have no right to look back on the result of Feb. 23rd elections, and hereby urge your Lordship to dismiss this petition for lack of merit, Ebi pleaded.

But Mr. Sunday Oyawole, leading counsel to the petitioners, dismissed all the claims of the respondents, especially that of 3rd Respondent, whose response, he claimed were only based on facts and not on points of law.

“The essence of reply is not to argue but to reply on points of law, so I urge your Lordship to disregard their arguments.

“Beside, the respondents couldn’t, in their arguments, lay a hand on any law to buttress their points and so were only talking on facts.

“On elections of Feb. 23rd, there was a duly collected result, which was canceled by an officer who had no business with it all.

“They are the people who know where the original result sheet of Feb. 23rd is, so they should provide it having agreed that all the results of all the polling units were collated.

“Your Lordship should order them to produce the results and announce our client and Party ,PDP as winner of that election,” Oyawole urged the tribunal.

Plateau Governorship Tribunal :Usani  Urges  Court To Disqualify Governor  Lalong For   Discrepancies Of Name,  Over Voting, Mutilation Of Results………

By, Giwa Alex, jos

Lt. General Jemimah Usani of the People Democratic Party (PDP) has urge the election tribunal sitting in Jos the plateau state capital to disqualify Governor Bako Lalong of All Progressives Congress (APC) for discrepancies of name, results mutilation ,over voting, defacing of result scores and others .

As his real name was Sule Bako Lalong, not Simon Bako Lalong which the 2nd respondent is now parading himself to lay claim to.

General Usani (rtd)made the plea during the adoption of final written addresses of the governorship election tribunal between Jemimah Usani of People Democratic Party (PDP) and Governor Bako Lalong of All progressives Congress (APC)

General Usani who is the petitioner, is represented by his counsel Mike Ozekhome(SAN)urge the tribunal to declare Usani the rightful winner of the 2019 governorship election in plateau State.

Ozekhome said my call for the tribunal to declare my client Jt. Usani winner of the last governorship in the State is predicated on three grounds, which are:

inconsistency in the change of name of the 2nd respondent, as Simon Bako Lalong instead of Sule Bako Lalong.

He further Summit that with the use of the name Simon Bako Lalong which the 2nd respondents sworn an oath to, has render all the other documents acquired by Simon Bako Lalong non and void.

The second ground which I want this honorable tribunal to declare my client JT Usani winner of the last governorship election, is that the election did not follow the laid down electoral guidelines and rule as it contained in 2010 electoral law as amended .

And the election was grossly manned by over voting which were more obvious in not fewer than nine out of the seventeen local government which made up plateau state.

That most of the election results where defaced , mutilated ,full of Canceallation and figures inflated in favour of the 2nd respondents who is the sitting governor of the state.

The counsel to the petitioners ,Chief Mike Ozekhome said that electoral process most be respected so that voters or the electorates vote will not be disenfranchised .

This is a process that can give hope to our democracy were voters votes shall be counted not the other way round.

He further urge the tribunal to declear the governor sit currently occupied by governor Bako Lalong as “Borrowed Throne” which I urge the court to vacate the 2nd respondents and give the rightful owner General Usani of the people Democratic Party (PDP).

Earlier, counsel to the 1st respondents, the independent National electoral commission (INEC) represented by his counsel Barr Clement Onwuenwunor

told the tribunal that the final written address dated 8th August,2019 on behalf of the 1st respondent ,we hereby adopt it as their argument in the suit filed .

Address in our defense against this petition ,we adopted by asking the Tribunal to strike out the evidence of -PW71 who is a staff of the 1st respondent whose both his evidence in chief and that of PW1 in questions and answers during the cross examination in the governorship in Plateau state.

The election was conducted in substantial compliance with the electoral act as well as the entire revelation rounded .

Meanwhile ,the counsel to Governor Simon Lalong, Lateef Fagbemi who is 2nd respondent said in their final written address dated 8th August, 2019 ,we humbly adopted and relying on the process .

The first point is that there is no point raised by the petitioners to warrant the cancellation of the election because of the electoral guideline was dully follow ,so I submit that the petitioners failed to proof in any of the relief sought before now ,he stated.

Although we have filed an application seeking the Tribunal to strike out the entire complaint ,in respect of petition we have about (742) polling units and 69 wards is tantamount to allegations .

We call that the performance of the petitioners is optimally very low so my submission is that the PW2 -PW71 which shows that their evidence be given no consideration for two reasons, citing the supreme court judgment .

According to him ,most of the witnessed brought can’t speak in English Language which the interpretation made very difficult to understand ,they always say ,”Hakane ,Hakane ,so I call on the Tribunal to disregard witness.

In addition, these witnesses were not listed which he refers the Tribunal to reply dated 19th August, 2019 ,the evidence proof that election was free ,fair and credible.

The 3rd respondent ,(APC)represented by it counsel Garba Pwul (SAN) said we have argued pending challenging the entire petition also items regarding the admissibility of some documents that was raised in our pre-hearing were we reject that some of them should be expunge .

In our final written address dated 8th August,2019 we hereby adopt the address as our final argument in the petition .

We associate our submission with the 1st & 2nd respondent raised fundamental issues of the 2nd respondent which give emphasis on his qualification and plead .

According to Pwul by all standard Governor Simon Lalong is qualify to participate in the election ,the petitioners complaints of over voting ,alteration ,we frown that they’re no issue .

About 48 witnesses were presented to the election Tribunal base on this ,we urged your Lordship to dismiss the petitioners petition for lack of merits .
