” That with Prima Farcie case before this honorable court, the application of the 1st and 2nd defendant, senator jang and Yusuf Pam cashier to jang as governor of plateau state has case to answer contrary to their applications before the Court.”
The implications of the ruling of the “No” case submission in favor of the prosecution (EFCC) are two folds ,firstly, which means the senator in the 8th assembly will enter for defence along with his Co- accused Yusuf Pam.
The second implications of the case is that the case will start afresh as the present judge, justice Daniel longji we be bidding farewell to the bar as he commence on retirement starting from 1st January, 2020 after 35 years at the service.

The agency counsel further stressed that they will not loose sleep over the accused intention to appeal the ruling of the Court over no Case submission.
It would be recall that senator David Jonah jang is facing trial over money laundering amounting to 6. 3 Billion naira he allegedly laundered during his tenure as the governor of plateau state from 2007-2015.

Sen Useni Urges President Buhari To Release  Jennifer Samuel And Others From Boko Haram Captivity .

By, Giwa Alex, Jos
Passionate appeal has been made to Mr President and commander of the arm forces of the Federal Republic of Nigeria president Mohammadu Buhari to put all the security in place and rescue the Plateau born Jenifer Samuel and others who were adopted by Boko Haram recently.
The Former Minister of the Federal Capital Territory, and senator of the Federal Republic in the 8th Assembly representing lantang constituency, Jemimah Useni of the people Democratic party made the passionate appeal.
In a press statement made available to our correspondence dated 29th Dec, 2019 in Jos the plateau state capital, and signed by the former senator media consultant Yiljab Ibraham charge the Federal Government to spare no effort and resources to free a Plateau citizen, and orphan, Miss Jennifer Ukambong Samuel, and others from Boko Haram captivity.
Miss Samuel, a midwife with Alliance for International Medical Action was kidnapped along Monguno-Maiduguri road along with her colleague and many others ,the kidnap which coincided with her father’s death anniversary.
“Gen Useni said, “It is painful to see many Plateau patriots captured away from home in the line of duty, and some, like Lawrence Duna Dacighir and Godfrey Ali Shikagham, both from Mangu LGA, have had to pay the supreme price in the hands of the insurgents in Borno State. It is all the more disturbing when the reasons for these kidnap and gruesome killings are tied to religious differences and as revenge for other killings outside the Nigerian borders. “
“I call on the President and Commander In-Chief of the Armed Forces of the Federal Republic of Nigeria to impress it on the Armed forces and all security services, the good people of Borno and surrounding States, as well as friendly nations to secure the release of Miss Samuel as well as the freedom of many other Nigerians in captivity. “
“Mr President, rise with all the valour from your training and the powers of your office to put an end to these impunities by hostile forces that want to keep this nation in perpetual fear. “
“I am also disturbed by a report that another Plateau citizen Bashir Abdulhamid with the Primary Health Care Department of Kanam LGA is among those captured by the insurgents. Bashir’s family and all of us must remain calm and strengthened in the hope that his ordeal will help to raise the kind of aid and action that will give peace to our land and our hearts.”
“It is indeed reprehensible and unacceptable to kidnap or take the lives of people who are out and about their legitimate and official activities to promote the good of the nation and the welfare of citizens.”
“In addition, the execution of some Christians and Muslims by the Islamic State in West Africa Province (ISWAP) to coincide with the Christmas celebration is clearly meant to provoke and insult the adherents of both religions in our country by edging them toward greater suspicion, anger and tension. But more, it is an act of cowardice accomplished by people whose undefined and godless agenda continues to be frustrated by the good works of good and courageous people even in areas of conflict.”
“I offer my deepest condolences to the families of the slain, and appeal to the families of those still being held captive to remain strong in prayer and positive in expectation.”
“I am however encouraged and confident that our armed forces and security personnel, who have been in the critical line of duty, will rise to the occasion in their intensified search and rescue missions to give much hope to Nigerians. Together as a nation, we will overcome this evil in our land.”

Emmanuel Goar said, contrary to what the coupist said that they were at the secretariat for an Exco meeting, further add that there is no time he can vividly remember that the party Exco meeting ever held by 6am in the morning.

“You are living witnesses that we had not held any meeting of the party Exco by 6am in the morning.”

He stress that as a staunch member of the PDP in the state, I have been moving ups and downs holding meetings with National Secretariat with the view of strengthening PDP on the plateau.

“All of us is aware that the issue surrounding about the leadership of the party on the plateau has been brought to an end by the National working committee with the resolutions that was read before the press and all that were around that every day. “

Among the resolutions which was very clear that the purported letter written by (16) members of the Exco in the state been withdrawn as all the allegations against the out gone chairman find to be force, and th chairman to resign if he so wish.

It is on record that there is a pending appeal at the Supreme Court with Suit No: SC/546/2018 wherein The Sun Publishing Limited appealed against the Judgement delivered by the Court of Appeal on the interim forfeiture order made against it by a Federal High Court in 2007 based on ex parte proceeding. “Further more, we are aware that both Senator Orji Uzor Kalu and Slok Nig Limited have since appealed the Judgment delivered by Justice Mohammed Idris and a hearing date given.
“We wish to reiterate that The Sun Publishing Limited is an ongoing corporate limited liability company and its shares are owned by various individuals distinct from Senator Orji Uzor Kalu. Therefore, the recent Judgment against Senator Orji Uzor Kalu should not be used to disturb the operations of the company and the proprietary rights of its innocent shareholders until the matters are dispensed with at the Supreme Court.
“In view of the foregoing, we call and appeal to the Attorney General of the Federation and the Minister of Justice to urgently intervene and advise EFCC appropriately on the legal consequences of its actions.”

“Three officials of the Economic and Financial Crimes Commission (EFCC) with four heavily armed policemen on Saturday, December 15, 2019 at about 10.00 am arrived the corporate headquarters of The Sun Publishing Limited at 2, Coscharis Street, Kirikiri Industrial Layout, Apapa, Lagos and put up a notice for staff and the general public to keep off the premises. The EFCC officials, who came in a white Toyota bus with registration number, ABUJA BWR-644GA, wrote on The Sun’s fence, “EFCC, keep off.” They also advised our staff to collect their personal belongings from the office as they will come back to seal the premises completely.
“We do not understand the legal basis for this EFCC action. The Notice of Appeal and Motion for Stay of Execution were duly served on EFCC by the bailiffs of the Court.
“It is also pertinent to state that EFCC vide a letter written by Counsel to The Sun Publishing Limited, dated 22nd May, 2018 and duly received by one Caleb Peter on behalf of Rotimi Jacobs & Co. was further put on notice of the pending appeal at the Supreme Court and advised to stay action in the matter pending the hearing of the Motion for Stay of execution and the appeal.
“Again, it is instructive to state that The Sun Publishing Limited was not a party to the case of EFCC vs. Orji Uzor Kalu & 2 Others, so we do not see why the Judgment in that case should lead to attempt to seal The Sun Publishing Limited premises.

And because of lack of funds which the state is currently facing, which is not peculiar with plateau state alone, we have advice the executive to concentrate on projects that will generate more revenue to the government instead of projects that cannot do anything for the state.

” The 9th assembly is not satisfy with the revenue mechinary of the government at all, as long as there is no visible government object on ground that can yield reasonable revenue for the government, when the attention of the government is more on recurrent expenditure and we didn’t embark on projects that will yield more revenue to the government, we are bound to suffer. “

By, Giwa Alex, Jos

The Chairman of Peoples Democratic Party (PDP) plateau State has finally resigned his position as the chairman of the party in the state following unresolved crisis that has rocked the party for close to a year now for allege misappropriation of funds.

As the embattled Chairman Hon .Damishi arrived at the decision of resigning to allow the state chapter of PDP that had been literally stagnant for the past eight months following the crisis to start moving again.

Hon. Damishi Sango make the revelation in a farewell press conference held at the party secretariat along Yakubu Gowon Way in Jos , the plateau state capital.

Sango who is relinquishing the party leadership for his Deputy Hon. Amos Gombi , though in Acting capacity as the chairman, said,

“April this year,2019,the state chapter of our great party has been rocked by a tsunami-like crisis that has threatened its very existence as one united political party. ”

“This followed my purported suspension along with my Deputy , respectively, by some members of the executive committee on trumped up allegations of mismanaging funds meant for the party’s logistics arrangements in the 2019 presidential election in the State”.

The former minister of Sports said following the unfortunate incident, determined to resolve the crisis and get the Chapter moving again, the national leadership of the Party, led by Prince Uche Secondus, set a three-man committee, under the chairmanship of Senator David Mark, to look into the said allegations and advise it accordingly.”

“The Senator Mark-led committee swung into action immediately, having an interface with individuals and different stakeholder groups within the Party in the State, including Senators Ibrahim Mantu, Jonah Jang and Jeremiah Useni; former Speakers of the State House of Assembly; sitting members of the National Assembly and State House of Assembly.”

” The three wise persons, after a painstaking exercise, dutifully submitted their report to the National Working Committee (NWC). On receipt of the report, an interactive meeting between the NWC and selected stakeholders from the state was convened at the Legacy House, Abuja by the National Chairman.”

At that August meeting, the National Chairman communicated the following, which were adopted as resolutions:

He however said the Senator Mark led Committee did not find me guilty of any financial impropriety, and so I was exonerated of all allegations against me;

In Pursuant to my being exonerated, the group of sixteen executive committee members should write to the NWC, withdrawing their allegations;

” Upon the withdrawal of the allegations, in consideration of the fact that there’s bad blood between me and most of my colleagues in the executive committee, particularly the group of sixteen, and to pave way for peace in the State Chapter, I should step aside as Chairman; and in line with provisions of the party’s constitution, my Deputy, Hon. Amos Gombi shall be Acting Chairman.”

“The group of sixteen have written to the NWC as resolved, I have been communicated by the NWC accordingly and I have also written to the NWC; the sequence of events is now complete,I am formally resigning my position as the State Chairman of our great Party.”

“I however express my sincere gratitude to the PDP family in the State for giving me the opportunity to serve in this capacity.”

Sango who held sway as the chairman of PDP for three years said he has not one day take the party and position as chairman for granted.

“I would like to place on record my gratitude to the national leadership of the Party for the cooperation I received in my official capacity as State Chairman, for standing by me at my most difficult moments, and for the amicable resolution of the crisis that tended to destroy all that we had laboured to put in place in the last three years.”

He advised the incoming excos to sustain not to tinker with the agreed zoning formula adopted by the party that has bring peace and harmony into the party.

“Hope that we deepen this understanding as we put our house in order and prepare for subsequent elections; and came up with a framework that saw us conduct one of the most transparent gubernatorial primary elections in our twenty-one years of practicing democracy in the State”.

” I cannot leave the stage without drawing our attention to some developments that have remained pervasive in the last twenty years in the life of our great Party in the State.”

The out going chairman decry the leadership crisis that had been the problem of the party right from time in the state.

“Although Plateau State is the birthplace of our great Party, its leadership, especially the tenure of the Chairman, has always been dictated by the whims and caprices of some forces. ”

“It is on record, and I stand to be corrected, that apart from Chief Raymond Dabo who acted as State Chairman after the exit of Dr. Haruna Dabin, no other was allowed to serve out his term.”

” The self-serving individuals have over the years, through their activities, hindered the optimal functioning of the state leadership, consequently leaving in its trail mistrust among the ranks, and ending up with a factionalized team “.

“My resignation today is a product of such activities of forces that usually feel that the leadership of the Party is there to do their bidding, even at the expense of majority considerations.”

Advice any person in the party seeking any elected positions to be dedicated to the party,

“Let me use this opportunity to specially speak to “those of you who may wish to contest certain offices/positions in the future. I have noticed over the years that there is always a tendency of creating confusion within the Party, or outright detection when things don’t go our way, even when primary elections are adjudged free, fair and transparent. Let’s resolve to always join hands with winners in greater interest of the Party.

” It is my earnest prayer that my exit today shall cause us to resolve that never again shall we allow narrow-focused personal or group interests to determine the tenure of elected leaders of our Party. We cannot afford to have such forced exits albeit through trumped up allegations, like in my own case to continue as a common feature of our journey”.

“As I draw this press conference to a close, I would like to, on behalf of my colleagues, I extend our depth of gratitude to the following individuals and groups their support and contributions of all forms to making the Party in the State to remain vibrant in spite of being in the opposition:”

Sen. Jeremiah Useni, our candidate and leader of the Party, for allowing us lean on his broad shoulders; he has, amongst other things, including the welfare of our support staff, ensured that we continue to operate from this present party secretariat Yakubu Gowon Way.

” He has also remained resolute in the defense of democracy by encouraging our team of lawyers to continue the search for the stolen mandate given him by the Plateau electorate.

” Our esteemed Members of the Board of Trustees from the State, Senator Ibrahim Mantu, Senator Jonah Jang and Ambassador Sir, Fidelis Tapgun, for allowing us leverage on their goodwill at all times;

” Members of the National Assembly, sitting and past, Senator Istifanus I. Gang, Hon. Beni Lar, Hon. Solomon Maren, Hon.John-Bull Shekarau, Hon. Timothy Golu, Hon. Simon Mwadkwon and Hon. Musa Bagos for their critical interventions to the State Chapter”.

“I am particularly thankful to my Deputy Hon. Amos Gombi who did not only stand with me, but demonstrated loyalty, while my travails lasted.

“I hold no grudges against those who felt and acted otherwise”.

“As I bow out today, feeling fulfilled, and having been cleared of the trumped up allegations, I wish to make a solemn declaration, that as a founding member of this great Party and a former minister of the Federal Republic of Nigeria, I will continue to avail the Party of my services at all levels and at all times. My doors shall remain wide open to all of you.”

Sango appeal to all to forgive one another, let go of sad chapters of the past , leave yesterday behind, and forge a partnership based on the ideals of this great Party.

I call on those I am leaving behind in the Executive Committee and other organs of the party to work in harmony with Hon. Amos Gombi, the incoming Acting chairman as the Party finds its footing once more.

“I urge the party faithful in the state to stand with our candidate and leader, and the Party as we go the last step to the Supreme Court in search of the mandate freely given to us by the good people of Plateau State”.

World Aids/Hiv Day Celebration, Lalong Urges Stakeholders To Join Rank And Fight The Disease.

By, Giwa Alex, Jos
As the world mark Aids/Hiv across the globe, the governor of plateau state Rt.Hon.Bako Lalong has call on the stakeholders in the health sector to close ranks with the plateau State government to eliminate the scourge of the disease.
As he pointed to the fact that government alone can not fight the scourge of HIV/Aids that is ravaging women and men across the globe, hence the need for all the stakeholders in the health sector in the state to support the government to reduce ,if possible kickout the disease.
Governor Bako Lalong represented by the commissioner for health in plateau State Dr. Nimkor Lar Ndem made the appeal on Monday 2nd December,2019 in a press briefing to mark this year 2019 “World Aids day celebration held at JD Golwark Secretariat in jos the plateau state capital.
This year Aids day which has its theme “Communities Make The Difference ” is observed worldwide annually every 1st December.
The day is not just an annual ritual, it is an event to reflect on where we have been, where we are and where we wish to be in our efforts to put an end to the HIV/AIDS endemic in Nigeria and Plateau State in particular.
This years event provides an opportunity to recognize as well as appreciate the essential role that communities have played and are still playing in the Aids response at the international, national, state and local levels.
Communities contribute to the response in many different ways; their leadership role and panachea for advocacy ensure that the response remains relevant all the time and grounded keeping people at the center and leaving no one behind, hence this year’s theme.
He said the theme “Communities Make The Difference is not only apt and timely but carefully chosen to capture and reflect the mood of the celebration.
“World Aids Day”, offers us an opportunity platform to highlight the role of “Communities” at a time when reduced funding and shrinking space for civil societies are putting the sustainability of service and advocacy efforts in jeopardy.
Therefore, the strong advocacy role played by communities is needed more than ever to ensure that AIDS remain on the political agenda so that human rights and dignity are respected and the decision-makers and implementers are held accountable.
“By the end of the 2018 statistic show that the 37.9 million people living with HIV; 700 new infection were acquired; 770,000 people died with HIV related causes, while the National (Nigeria) prevalence rate stood at 1.4%(NAIIS- 2018) and the state Plateau is 1.6% But be for 2018 NAIIS survey, the country Nigeria prevalence rate was 3.1% while the state prevalence rate stood at 1.9%.”
He stress that the scourge of
HIV/AIDS continued to be a major global public health issue, with increased access to effective HIV prevention, diagnosis, treatment and care, HIV inffection has become manageable chronic health condition, enable people to live long and healthy live.
Despict the huge success recorded by the state government last year in providing RTK (Test Kits), training of LGA PHC staff, holding of review meetings, local govern PHD directors/LACA M&Es, orientation of CSOs, Ward development committee and the community leaders from all the 17 local government, we still have a challenge relating to our health system, infrastructure, unmet needs of commodities, data quality, human resource for health and funding.
These challenges hinder access to HIV/AIDS prevention and treatment service in Nigeria.
“This underscore the point that the Plateau State government should not be left alone to bear this Borden, but community group, development partners, and organization private sector most play there part to end this deadly scourge.
“We need to increase our investment on the health of our citizens, optimize our response strengthen our coordination and accountability framework in order to achieve return on our investments on health.”

Zamfara State : 1.9 Billion Gratuity Payment ,Yari Put The  Record Straight.

By, Our Reporter

The immediate past Governor of Zamfara state Abdullaziz Abubakar Yari has finally respond to the the write up which has gone viral on the the social media, with the caption “Expenditure Incurred Out Of The Gratuity Account “.

Alh. Abdul’aziz Abubakar Yari who is the immediate past Governor of Zamfara state through the “Concerned Citizens Of Zamfara state said,

“Ideally, no one should have wasted his time to respond to the captioned. But it has become imperative, especially in this era of political sycophancy, where some appointment seekers in the name of politics and democracy have to turn our political terrain into one lucrative venture; to put it mildly, politics of bread and butter.

“I read with irritation a nauseous write-up concerning the content of a paper that was still trending in the major online papers and social media platforms which reads;”

“Expenditure Incurred out of the Gratuity Account” attributing the input of the paper to accusing the former governor of Zamfara State Alhaji Abdul’aziz Abubakar Yari of sphoning zamfara state gratuity account the sum of 1.9 billion out of 2 billion meant for the payment of gratuity to Zamfara workers two days before handing over.”

“When I first read the content of the paper and other articles written about it, I thought about advising the editors of the online papers against allowing hired, obscure keyboard mercenaries to use that medium to champion the warped political agenda of masked sponsors; but then, I realized we are in a new world of press freedom – where people can make any statements, comments and arguments, however, stupid, lies and tenuous.”

“Nauseating though, the tone and intent of the writing nevertheless confirmed the worst fears about the possibility of using orthodox media platforms to upload junk by fringe commentators with the aim of dragging the name of the most successful, gentle and humble former governor of Zamfara state Abdul’aziz Yari into the political rascality by political prostitutes and attention seekers.”

“Reliable information confirmed that, the paper was intentionally released to the public consumption by the officials of Zamfara state government just to gain some political point, but unfortunately and apparently the people sponsored to do the job are quite unprepared and scantily equipped with facts, then resort to the display of their total ignorance of the matter and the laws in the Nigerian constitution.”

“Indeed, every right thinking individual who reasons with his brain and cerebrum and not anus on seeing the content of the paper with allegations attached to it, will begin to ask himself what all about the political brouhaha ? “

“Why accusing Gov. Yari of stealing from gratuity account ? Is that not backed by the Nigerian law for a governor to pay workers pension and gratuity ? The names that appears on the list have not gotten their payment ?”

” Any evidence of a single kobo that was missing or diverted from the payment ? Why all these manifesting

of ignorance, hypocrisy and rascality of the highest order ?. The constitution of the Federal Republic of Nigeria gave Gov. Yari every intended backed up and ability to pay civil servants their gratuity and that what Gov. Yari did”.

“One important observation that should not escape the minds of critical and educated readers is the fact that throughout their submission on zamfara state gratuity account, no one among them was able to dispute, deny or reject the fact that Gov. Yari paid the sum of 1.9 billion to the categories of persons mentioned on the paper, but yet, the current government of zamfara state and it’s officials were unable to explain to the people of Zamfara state where the sum of over N2billion fertilizer sales proceeds was pocketed. It was on record that Gov. Yari consulted the leadership of the Zamfars labor congress before the pension was paid. And the funds were refunded from the proceeds of fertilizer sales. Over N500 millions was paid to the state government by the people of zamfara state on fertilizer sales, but, yet the money are no where to be found. The big question that remains in the minds of majority of Zamfarawa is, where are the billions of naira that was credited to the zamfara state Access bank account on fertilizer sales ?”

” Where are the billions or the fertilizer ? What are they talking about on the said billions of naira ? Can Gov. Matawallen Maradun with all honesty and sincerity explain whereabout of the money or enumerate any projects he executed with it ?”

“Also, the argument and allegations put forward on the said expenditure incurred out of the gratuity account by these same shameless cowards are nothing but shallow and empty.

“For the government of Gov. Matawallen Maradun to argue on accountability and transparency with the former administration of Gov. Yari is like a chicken taking itself to the oven.”

“Ask Gov. Matawallen Maradun and any of his government official, when the new government in Zamfara State was inaugurated on May 29th this year, it knew the developmental achievements of former Governor Yari it met on the ground were as daunting as they were widespread, most of them multi-sectoral and has direct bearing to the masses.”

” But the current administration didn’t tackle insecurity but aggregated it. It didn’t alleviate poverty but institutionalised it. It failed to mend fences between victims and their aggressors but left them to hold grudges and even resort to revenge despite their so-called and acclaimed “peace initiative ?.”

“But, unfortunately this latest effort of media smear campaigns on the persons of former Gov. Yari by the government of zamfara state and it’s hidden elements only exposes those who have seen themselves into the government house by accident, because they were not been the choice of zamfara people and they were not elected by the people of Zamfara state”.

“These political ignorant, touts, hungry, clown, ramshackle, ill-informed and baseless sycophants will remain irrelevant in the politics of Zamfara state.”

“For records emphasis, Gov. Abdul’aziz Yari is an institution who represents a symbol of humility and good virtues. He is trustworthy, incorruptible; transparent, discipline, meticulous, law abiding, selfless, God fearing, humane and tolerant. He is a magnificent achiever and a great leader of global accomplishment. He is highly intelligent, cosmopolitan, brave, determined, indomitable and focused leader who is progressive in all ramifications. He stands tall in the test of time because of his unrepentant zeal for the well being of his people. He is a leader with a listening ear. Gov. Yari as a people oriented leader with uncommon vision and perseverance especially in his collective courage as a team player for better Nigeria society can never be intimidated or quashed by any frustrated, senseless, mediocrity and desperate political prostitutes.”

“Indeed, from the political evolution of the global existence down to history of Nigeria, the activities of great leaders are measured by the degree of their capacity to practically transform their society to a better and developed communities of happiness and peace, and this Gov. Yari did. He had a very intractable and uncommon record of historic legacies which is apparently next to none in Zamfara state. He is a coordinated politician and surrounded with exceptionally intelligent people.”

“Gov. Yari sees leadership as a social responsibility to respond to his people’s needs. He never views leadership as a venture of commercialization and hooliganism as was outrightly portrayed by Matawallen Maradu’s government now. “

“In his determination to exacerbate the profound necessity for greater and accelerated development in Zamfara state, Yari serves as architecture of Modern Zamfara state, likewise, Yari’s government in Zamfara was a government of integrity and the people of zamfara state will continue to appreciate him and his unprecedented achievements.”

The judgement which has 5 justices delivered that the 2nd respondents Simon Bako Lalong contrary to the allegation that the WAEC certificate he swore to an oath to have claim to have obtained, is fake and forge because is carrying another name instead of Simon Bako Lalong, Sule Bako Lalong.

While speaking with journalists, the Executive Director, Saphira Global Center for Social Development, Mrs Yil Fomwul Gonsum, a filmmaker and social activist, with passion for humanitarian work said the project was embarked upon because of the low sensitisation on health and hygiene in particularly in the target community.

She further said that similar programme would be carried out in hard to be reached Christian community in the state very soon.

She added that community intervention hardly reaches the beneficiaries saying the programme was facilitated through crowd-funding with a major supporter from Area Manager of Molfix for North East, Terry Chukwunoso Eze donating ten cartons of Molfix Sanitary Pad called Molped.

In her remarks, Ms Jemila Idris, the Chief Executive Officer of Hanan Initiative for Women and Youth said her target community engages in open defecation and different kinds of health risk activities stressing that outbreak of diseases often begin in these hard to be reached communities and later gets to the general public.

Plateau State:Appeal Court Judgement, J.T Usani Coast To Supreme Court.

By, Giwa Alex, Jos

The governorship candidate of 2019 general election under People Democratic Party (PDP) Gen.J.T Usani is coasting to the Apex court of the country Supreme Court.

This to challenge the appeal court judgement on governorship election tribunal delivered 29th Nov, 2019 in Jos the plateau state capital ,which ascribed to Simon Bako Lalong as not only qualified to contest the 2019 election, but “Eminently “qualified.

The intention of the immediate past senator of the 8th National Assembly was made known in a press release through my whatsapp message in Jos the plateau state capital.

According to the press release signed by the senator media consultant Yiljab Ibraham read that the retired general in the Nigeria Amry cannot afford to throw the towel at his critical period particarly when there are many issues that needed to be strengthened in the judgement.

“Governorship Candidate of the Plateau PDP in the 2019 election, Lt. Gen (Rtd) Sen. Jeremiah Timbut Useni, has instructed his legal team to prepare and proceed to the Supreme Court immediately to challenge Friday’s judgment of the Appeal Court which affirmed the decision of the lower tribunal.”

“The decision was taken during a review meeting with the legal experts and General Useni. He praised them for holding strongly to the tenets of the profession and in bringing the issues in the petition to the forefront. He commended the lawyers for standing firmly on the side of the rule of law and democracy.”

Useni is determined that certain issues contained in the judgment must be straightened in the interest of justice, democracy and the future of Nigeria’s children.

“Our cause is the right cause. We should not make the law look as if it is not important. Let the Supreme Court declare whether lying on oath is not against the law.”

“He described the judgment of the appellate court as a surprise, especially having dismissed the two Cross Appeals of the Cross Appellants as lacking in merit and an abuse of court process.”

“Sen. Useni said he was also surprised that the judgment, delivered by Hon Justice O.A Otisi completely avoided making any pronouncement on an earlier judgment of the Supreme Court which reversed the decision of the Court of Appeal expunging the testimony of 21 of his witnesses.”

He however thanked PDP officials, stakeholders, and supporters for standing strong and united all through the period the case lasted at both the tribunal and now the Court of Appeal. He assured that the mandate of the people of Plateau State to him and the PDP is sacrosanct and will still enjoy his support and commitment.

Appeal Court Judgement, Garuba  Pwol Advice  PDP To Shield Their Sword.

By, Giwa Alex, Jos

The legal luminary,G.S Pwol(SAN)has advice the people Democratic party (PDP)to shed their sworn and close rank with the ruling All progressives Congress in plateau State to move the state forward.

Although is the constitutional rights for them to go to the Supreme Court over the judgement, but you most not pull the string to the end before you proof a point, come let amend the fences and let move plateau forward.

Chief Pwol (SAN) who is the counsel to the 2nd respondents Simon Bako Lalong of the All progressive Congress (APC) give the advice in an interview with our correspondence at the appeal court sitting in jos the plateau state capital immediately after the governorship election judgment who give victory to the incumbent governor Simon Bako Lalong.

“There is no point dissipating energy or trying to proof a point, both APC and PDP we are one plateau state, let team up and build a veril plateau state for the common good of the masses. “

Although the PDP has their constitutional rights to approach the Supreme Court, we are ready to met them on the merit of the case in accordance to the law of which I don’t doubt in my mind that their opinions will not be different.

The Senior Advocate Of Nigeria (SAN) said the judgement of the appeal court made up of five justices reaffirm the judgement of the lower tribunal that is made up of three justices.

” After giving due considerations to the argument and counter argument, processes in the files right from the tribunal come to the conclusion that what lNEC did is right by declaring the 2nd respondent winner in the governorship election conducted 23rd Feb,2019 is right.

This has help further to buttress the point that the governor Simon Bako Lalong who contested under the platform of All progressives Congress (APC) won the governorship election in the state contrary to the insinuations that he didn’t.

Pwol said the judgement of appeal court today has also go along away to put to rest the eligibility of the 2nd respondents Simon Lalong that he not only qualify but “Eminently “qualified.

“We are fully satisfy that the justices that deliver the judgement base on merit ,without fear, favor affection or ill will. “

“If the millions of Nigerian youths can have something doing to earn a living, they will not have time for “Hate speech”.

“if people are allowed to elect their leaders in a free and fair election there will be no “Hate Speech”.

“So, something gave birth to hate speech and that is what the Senate should address.

The former Publicity Secretary of the All Progressives Congress(APC) in Niger State, Comrade Jonathan Vatsa, has lambasted the 9th Assembly of the Nigerian Senate for the proposed bill seeking death penalty for anyone convicted for hate speech.

While addressing selected journalists in Minna, the Niger State capital, the former Commissioner for Information, Culture and Tourism in the state described the move as not only laughable but a direct invitation for anarchy.

The APC chieftain also advice the 9th Assembly to also propose a bill that will apply for lands in the 36 states, including the Federal Capital Territory, Abuja as did for Ruga to be used as cemetery for hate speech offenders that will be killed.

According to Vatsa:

“I call on Senator Aliyu Sabi Abdullahi the proponent of “Hate Speech Bill ” to also propose a bill that will ensure we have separate cemetery for offenders so that we can have it as tourist sites with inscriptions ‘Hate Speech’ cemetery because the offenders may also include those of us who have benefitted from “Hate Speech”.

“What a shame.”

Vatsa wondered why the (APC)-controlled Senate should never, ever contemplate such a “draconia and unpopular law,” saying: “We the (APC) rode to power in 2015 through “Hate Speech”.

“We (APC) brought hate speech to Nigeria politics and I am one of them.

“As a Publicity Secretary of the APC, I know how we used hate speech to mobilize Nigerians against the then ruling party.

“And it paid off because Nigerians eventually hated the Peoples Democratic Party.

“Before 2015, Nigerians did not know anything like hate speech.

“In fact, since the return of democracy in 1999, we are just hearing about hate speech.

“APC as a political party brought hate to politics in form of propaganda.

“The truth must be told: we are the architect of hate speech and nobody complained about it.

“We enjoyed it and it worked for us.

“If we think we have failed Nigerians in our change promises, we should be bold enough to tell Nigerians that we are sorry, we couldn’t deliver, but to try to cage them by trying to introduce or recycle Decree 4 of 1984 in the name of hate speech is unacceptable.”

The APC chieftain while blaming the Senate Deputy Whip, who is from Niger North Senatorial District, Aliyu Sabi Abdullahi, warned that the proposed bill for death penalty for hate speech “might consume all of us”.

Vatsa said rather than proposing death penalty for hate speech offenders, it should be death penalty for corrupt leaders in this country because “corruption and injustice gave birth to what is now being called hate speech.

“If there is justice, equity, fairness and respect for rule of law, there will be no hate speech.

“But when people are being marginalized and denied their right, surely there will be hate speech.

“You cannot stop people from expressing their freedom of speech.

“If the Senate is proposing death penalty for hate speech, then what will they do to Boko Haram, armed bandits, kidnappers, oil bunkers and treasury looters both politicians and civil servants?

“All these things are worse than hate speech.

“There are more pressing issues to Nigerians that the Senate should look into and address instead of wasting their energy on an unpopular bill like this one that will not see the light of the day.”

Vatsa however believes that there are more to the proposed hate speech bill, adding: “If the rumor of President Muhammadu Buhari nursing the ambition of third term is correct, then they need death penalty for hate speech to silence everybody who will want to oppose him.

“But the Senate should know that he who lives in a glass house should not throw stone because they cannot be there forever.

“When they leave the Senate, the law can catch up with them.

“Again, if the money meant for constituency projects are utilized for the purpose it was meant for and the people begin to see dividends of democracy, there will be no need for hate speech.

“If the millions of Nigerian youths can have something to do to earn a living, they will not have time for hate speech.

“If people are allowed to elect their leaders in a free and fair election there will be no hate speech.

“So, something gave birth to hate speech and that is what the Senate should address.

Plateau State Appeal  Tribunal :Mike Ozekhome Pray Court To Return  Borrowed Mandate By Governor Lalong To J.T Useni

By, Giwa Alex, jos

Chief Mike Ozekhome (SAN) counsel to governorship candidate of the People Democratic party (PDP) in plateau state in the 2019 general election Gen. J.T Useni has pray the court to retrieve the borrowed mandate by governor Simon Bako Lalong to Gen . J.T Useni the rightful winner of the election under contention.

As the legal luminary Ozekhome said, its impossible for two Obas, Ezes and Emirs to be in one palace ,one most give way to the other.

The Edo state born Senior Advocate of Nigeria(SAN)Dr. Mike Ozekhome stated this during the hearing of the governorship appeal tribunal between governor Simon Bako Lalong (APC) and J.T Useni of the (PDP) in an interview with group of journalists at the appeal court premises sitting in jos the plateau state capital.

Que: sir,the court has just hear your governorship election appeal, how did you feel, and what is your hope?

President Mohammadu Buhari’s case with Atiku Abubakar is totally different from the fact of this case ,just as the Heaven is different from the Earth, and in law ,case is an authority on what it’s related .

You cannot transfer unrelated fact from one to another,in this case, governor Simon Bako Lalong affirmed in the trial tribunal as put down in trial tribunal pages 278-279 gives different names ,qualification ,non of them tied to any particular names, when they ask him in form (CF001) Exhibit (31), have you ever Change your name, he said “NO” by putting dash “-” the tribunal found that because he put dash meaning “NO”.

The name of Simon Bako suleh which is on the secondary school qualification is never tied to him in any of the documents.

The tribunal after finding that he gave false information ,surprisingly with all respect turned around and said Oh! this false information is not substantial enough to contest an election .

If the electorate are going to vote, they should be able to know who they are voting for, they should be able to know this is A, B or C.

Otherwise ,as I told the court today 22nd November, 2019 during the appeal hearing of General Jeremiah Useni against governor Simon Bako Lalong, there may came an era where anybody can pick -up another person’s certificate like picking the certificate of Chief Mike Ozekhome by going to swear to an affidavit, although the certificate bearing Ozekhome that Mukalia Ozekhome, Michel Ozekhome, we will be in a dangerous politics if we should allow that to happen.

This is one case the intermediate court, the court of appeal should put its leg down and up hold section (138)of the constitution which showed that the grounds of qualification are both “Pre and Post election matter “,that the Supreme Court never held that they are pre election matter only

They were citing one or more less over (20) twenty cases in one of the judgement ,both of them post election that was the main judgement decision of the court in this case.

The main decision of the Supreme Court on Atiku Vs Buhari which spans over One Hundred pages ,never ,ever said qualification is a pre- election matter is both Pre and Post election matter.

The three authorities I give the Court during the hearing today and summit to the Court, is not “Concurring but Decenting “,because concurring judgment cannot go separate from the main judgement.

We have be able to distinguish from the two, we believe that this is the particular case for this tribunal to hold that Gen. J.T Useni popularly, very fairly and credibly elected by the people of plateau State to be their governor from 2019-2023 and that popular mandate which presently in the custody of governor Bako Lalong should be retrieve and given back to Get. JT Useni because there could be no two Emirs , Ezes and Obas

in one palace.

The real Eze, Emir and Oba is Gen. Jeremiah Timbut Useni.

APC Should Apologize To Nigeria For Renegade On  Promises, Instead Of Pursuing Hate Speech Bill……… APC Chieftain

By,Our Reporter

The All Progressive Congress (APC) been advised to apologize to the people of Nigeria for the party inability to fulfill its electoral promises to the Nigeria citizens and stop pursuing “Hate”proposing death sentence for offender.

As there is no smoke without fire,

“If the millions of Nigerian youths can have something doing to earn a living, they will not have time for hate speech.

“if people are allowed to elect their leaders in a free and fair election there will be no hate speech.

“So, something gave birth to hate speech and that is what the Senate should address.

The APC chieftain also advised the 9th Assembly to also propose a bill that will apply for lands in the 36 states, including the Federal Capital Territory, Abuja as did for Ruga to be used as cemetery for hate speech offenders that will be killed.

According to Vatsa:

“I call on Senator Aliyu Sabi Abdullahi the proponet of “Hate “bill to also propose a bill that will ensure we have separate cemetery for offenders so that we can have it as tourist’s sites with inscriptions ‘Hate Speech’ cemetery because the offenders may also include those of us who have benefitted from hate speech.

“What a shame.”

Vatsa wondered why the APC-controlled Senate should ever contemplate such a “draconian and unpopular law,” saying: “We rode to power in 2015 through hate speech.

“If the Senate is proposing death penalty for hate speech, then what will they do to Boko Haram, armed bandits, kidnappers, oil bunkers and treasury looters both politicians and civil servants”?

Court Discharge And Acquit Dr.Odeh Over Police Allegations, Acount To Be Unfrozen

B

y, Our Reporter

The High Court Sitting in jos the plateau state capital has discharged and acquit Dr. Michael Odeh over police allegations.

The Plateau State High Court presided over by Hon. Justice Daniel Longji, has discharged and acquitted Dr. Michael Owoicho Odeh, in Suit No. PLD/j75/2016, filed by the Commissioner of Police, Plateau State Command, against one, Orji Ifeoma Sharon Stella and himself (Dr. Odeh), owing to the inability of the Prosecution to establish a prima facie case against Dr. Michael Owoicho Odeh.

You would recall that, the Prosecution with the leave of Court, preferred a Nine (9) Count charge, ranging from Criminal Conspiracy, Theft, Misappropriation, Criminal Breach of Trust, Received Stolen Property and Concealment of Stolen Property against Orji Ifeoma Sharon Stella and Dr, Odeh, punishable under sections 97, 309, 312, 287, 289, 317, 319, 323, and 364 of the Penal Code Laws respectively.

However, throughout the hearing of the case, the Police called 14 witnesses and tendered Exhibits P1 to P41 and admitted in evidence, while evidence from the accused persons were, Exhibits D1 to D5. In the hearing process, the Bank Account of Dr. Odeh and that of his Hospital El-Roi, were also frozen.
At the end of the hearing of the Prosecution’s case, the Counsel to the accused persons (1st and 2nd) made a No Case Submissions, to which the Prosecution made a joint reply to the No Case Submissions.

Danboyi (Esq), of Shanding, Danboyi & Co. 7a Suzi Garden Tafawa Balewa Street Jos, Plateau State, Counsel to the 2nd Defendant in his No Case Submissions relating to the Charge No. PLD/J75C/2017, submitted in part that:
“The entire allegations of conspiracy is totally founded on unsubstantial suspicion of the nominal complainant, and totally not supported by any evidence.

“Throughout the length and breadth of the nominal complainant’s evidence, he never linked the 2nd Accused person (Dr. Odeh) with the alleged diversion of funds from Choco Condiments Nig. Ltd.
“To further show that this Count of Conspiracy, just like all the other Counts proffered against the 2nd Accused person (Dr. Odeh), are just based solely on the figments of the PW13’s imagination and baseless suspicion, PW6, who is one of the IPO in his evidence”.
However, Hon. Justice Longji, in his Ruling, dated 7th November, 2019, held that, “A No Case Submission may be upheld where:-
a. There is no evidence to prove an essential element of the alleged offence.
b. The evidence adduced has been so discredited as a result of cross-examination, and
c. The evidence is so manifestly unreliable that no reasonable Tribunal or Court can safely convict.
In the case of TANGO vs. C.O.P (2007) 12 NWLR (part 2049) p-the Supreme Court held thus:
“Therefore when a submission of no prima facie case is made on behalf of an accused person the trial court is not thereby called upon at that stage to express any opinion on the evidence before it. The Court is only called upon to take note to rule accordingly that there is before the Court no legally admissible evidence linking the accused person with the commission of the offence with which he is charged”.
And in the case of Okafor vs. State (2016) LPELR—26064 (SC) Sanusi JSC had this to say:
It also must be pointed out at the stage of “No Case Submission” is made, all that the trial Court is supposed to consider is not whether the evidence so far adduced by the Prosecution is sufficient to justify conviction but simply whether the prosecution has made out a prima facie case requiring some explanation from the accused person as regards his conduct or otherwise.

“Accordingly, it is my holding that Counts l, ll, lll, lV, Vl and Vll of the charge no prima facie case had made out to warrant him (Dr. Odeh) to be called to enter his defence.

From the Ruling of the Court dated 07/11/2019 obtained by REALITY, it is expected that his Bank Accounts would be made active, wherever they may be domiciled.

Kogi State University Renamed After Prince Abubakar Audu.

By, Our Reporter

The state owned university, kogi state university has been renamed after the former governor of the State and political sage Prince Abubakar Audu.

As the political followers of Audu ,under the auspices of Abubakar Audu political family expresses their gratitude to the sitting governor of Kogi state, Yahaya Bello for keeping the name of the late political sage alive by naming the state citadel of learning after him.

In a statement jointly signed by the spokesman of the Audu political family, Dr. Odekina Abutu and Chief David Dare Olatunde, the Maiyegun of Isanlu and made available to journalists in Jos on Sunday, the biological and political family fulsomely thank the governor for his kind gesture and applaud his courage and wisdom which led him to so doing.

In the same vein, the Audu family urges the public to translate the event as nothing but a kind gesture of goodwill from the Governor.

The statement reads:

“The Audu biological and political family express their profound gratitude to His Excellency, Governor Yahaya Bello for the honor done to our late leader. It is a gesture that no doubt, gladdens our hearts.

“The late Prince Abubakar Audu was a leader who never relented on his quest to bring excellence to Kogi State. His was a great service to us all and immortalising his name is a right step in the right direction by Governor Bello.

As regards the whisperings going on in certain quarters, renaming of Kogi State University (KSU) to Prince Abubakar Abubakar University (PAAU), we wish to make it clear that it is not a political event, neither is it couched in a political charade. It is a profound kind gesture aimed at extending honor to whom it is due, or in this case, immortalization to whom it is deserving of it.

“We beseech our people not to give it unintended undertones in a bid to push distorted narratives and remove from the lustre of the occasion. Governor Yahaya Bello renamed the university out of his own volition in good faith, and not to seek political favours.

“Our late leader deserves this honor and more for his humongous and incredible service to our beloved state. Those who see and contend otherwise are just playing the ostrich. We should not interpret every occasion as mere politics simply because politicians are involved. Renaming KSU to PAAU is a serious event that should not be politicized but appreciated as such. A gesture of goodwill may cost very little, but its true value can be incalculable.

“By and large, we implore you all to please, out of respect for our late leader and hero, desist and cease from running political commentaries regarding the renaming of the state’s institution by the governor”, the statement reads.

The Audu biological and political family opined they remain eternally appreciative of governor Yahaya Bello’s immense goodwill gesture, adding that it is an august phenomenon that will not be forgotten in a hurry.

Berom People Of Plateau State  Disown Sen. I. D Gyang,Call For Explanation .

By, Giwa Alex, jos
Senator Representing Jos North District at the National Assembly Senator I.D Gyang has been disown buy his kinsmen as they call for explanation.
This is over statement Accredited to him that the senator has gone to apologize to the Fulani to forgive the Berom in what ever way they most have offended them.
In a press statement held on 8th Nov, 2019 in Jos, the plateau state capital , sign by it Chairman Mr.David Choji and it Secretary Pam Marku said the action of the Berom born Senator did not represent the the thought of the Berom nation on the the plateau an Nigeria as whole.
“This briefing is of two folds want to state here and now that, his action and utterance came as a shock and very embarrassing to us, as we never gave him such mandate in the conflict circle, to delve into the debacle between the Berom people and the Hausa Fulani.”
“We want to state that, Sen. I. D. Gyang, cannot be our spokesman at that level, when we still have occupants of our Traditional stools, Socio-cultural groups alive and our people Internally Displaced as Internally Displaced Persons (IDPs) still exist and displaced from their ancestral homes.”
“We therefore, want to use this Press Brief to dissociate the Berom people from his politically packaged forgiveness exercise that was consummated at his residence in the just celebrated Sallah.”
They said the apology of the Senator is not only wrong, but at the same time untimely.
“Secondly, with the utterance of the National President of Miyetti Allah Kautal Hore Socio-cultural organization, Abdullahi Bodejo, saying that, there was no basis for Fulani Herdsmen to apologize to Governor Samuel Ortom, over alleged killings of Benue people.”
As the group call the Senator apology absurd when the Fulani themselves said they will never stoop low to apologize to anybody
“Stating and I quote that, “I am the National President of the Miyetti Allah Kautal Hore, I didn’t apologize to anybody; our organization didn’t apologize to anybody because, Fulani Herdsmen didn’t kill or hasn’t killed anybody. I was surprised where journalists got that story. Maybe, the journalists wanted story to sell their papers. It is fake news!”
The group however use the medium to send strong warning to I.D Gyang,
“We, as Berom people, want to also use this Press Brief to call on Sen. I.D. Gyang to reframe from representing the Berom people in such capacity and follow the basic Principles of Democracy.”
“Even at that level, he should also realize that he is not the political leader of the Berom.
Based on the Fulani National President’s revelation above, we use this medium to call on Sen. I.D. Gyang to tender an unreserved apology to the Berom People and the entire Plateau people now, as the forgiveness package meant to deceive the people has crumbled in the face of TRUTH”.
“Furthermore, we call on Sen. I.D Gyang, to tell the people of Plateau State of what has gone wrong with the Political Son and Fatherly relationship between him and the former governor of the State, Sen. Jonah David Jang, his Boss, while he served as Permanent Secretary Security.”
“We also want to know, why, Sen. Gyang is celebrating and touring around the state, with some alleged political foes, antagonists of Jonah Jang’s immediate past administration, close rivals and opponents to his political interest for the Berom and appointing them as Special Assistants, while his former Boss, Sen. Jang is been prosecuted by the Economic and Financial Crimes Commission (EFCC) at the Plateau State High Court in Jos.”
“In addition, we want to also submit that we are aware that there are already appeals flying out of the Plateau State High Court, presided over by Hon. Justice Daniel Longji, to the Court of Appeal concerning some of his rulings in the on-going trial of Sen. Jonah Jang. We can also observe desperate moves by several people to see that the Senator is jailed over the allegations made by the EFCC hence, the Amended Charge recently filed by the EFCC.”
On this note, we wish to inform the general public that we have directed our legal team and members to look into our findings and see what can be legally done, to address these perceived plans, which some of our Sons and Daughters are also involves in.

Breaking:America Dollars  Is At The Verge Of Collapse As Nigeria Sign Currency  Swap Deal With  Republic of China.

By, Giwa Alex, jos.
Nigeria just be out if bondage as the American dollar is at the verge of collapse, and may no longer be the only be the only currency to determine international trade.
This is as the Central Bank Of Nigeria has finally sign currency swap with the Republic of China for ease of doing business.
What this means is that all the business transactions hitherto carried out even in China using dollars will no longer be so as China currency will now be use instead of the hitherto “Almighty” America dollars .
The implications of this new deal with China government is that all the goods been bought with dollars even in China market will now be purchased with China currency which automatically reduce the price of goods and services due to low exchange rate of Chinese currency compare to America dollar which is on a high side.
The importance of this is that since almost 70% of the goods we import come from China and Asia and 12% America why must we use Dollars to transact with China? from now instead of using dollars at N350 to 1dollar to import those goods, we can now buy Yuan at 47 naira to 1 Yuan and import those stuffs directly.”
” Soon you will be buying that techno phone you bought at N80,000 for N12,000.”
“Instead of buying these goods in dollars in China, we will now buy them in Yuan which is 5times cheaper than dollars.”

yy

” A giant stride against Nigerian looters who will not want it to be reported or allow end-users to understand this victory over supremacy of dollars in our daily lives and economic activities.”
Up coming reality is that from days to come try and monitor exchange rate.
“Some of those people who hoarded foreign currencies to make gains will off load them in order not to have heart attack over their huge loss arising from the currency swap deal with china.”
“Dollars and pounds will flood everywhere with no buyers, as the buyers will draw naira from their accounts in banks with presence in China.”

6.5 Billion Money Laundering Case, Jonah Jang Call For Re-Cross Examination  Of Prosecution Witnesses.

By, Giwa Alex, jos

Senator Jang 6.5 billion money laundering case has taken a new dramatic twist as the immediate past governor of plateau state Senator David Jonah Jang has call for all the prosecution witnesses to be re-cross examined.

Speaking through his counsel Edward Pwajok (SAN),said the re-cross examination of the prosecution witnesses is very imperative to illicit more information from them on the area of the new amended charges.

But what would have be another smart move by the Economic and Financial Crimes Commission(EFCC),objected to the application of the 1st respondent Jonah jang for all the prosecution witnesses to be recall for re -cross examination.

The counsel to the 1st defendant Edward Pwajok (SAN), argued that the reasons is predicated on the amended charges which touches the entire gamut of the case including the Federal government of Nigeria and the apex financial institution of the country, the Central Bank of Nigeria (CBN) and for fair hearing it would be nice for all the witnesses to be recall for re-cross examination.

After argument and counter argument, justice Longji rule that since the new amended charges touches the entire gamut aspect of the case, it would be wise for the interest of justice for all the prosecution witnesses to be re -cross examined to cover the new areas thrown up by the new amended charges by the prosecutor.

Pwajok maintained that the team of lawyers to David Jonah jang head by the legal luminary Mike Ozekhome (SAN) will study the amended charges against the 1st defendant Jonah jang, and possiblel

y. challenge it at the appeal court, as the charges which is tag “Approval and Transfer”is not know in law.

The case has been adjourned to Oct, 30th, 31st and 1st of Nov, 2019 for the re- cross examination of the prosecution witnesses.

It would be recall that in the last adjournment ,sitting Sept, 30th, 2019 the Economic and Financial Crimes Commission (EFCC)come up with an application to amend some of the charges 1 to 17,probably because they were no longer comfortable with the way the case is moving contrary to their expectations.

The “Approval And Transfer”,

the 1st defendant Jonah Jang through his counsel Edward Pwajok (SAN) vehemently opposed the application on the ground that the phrase is not know in law, and if it allow to scale through, it would amount to making caricature of judicial process.

The 1st defendant further added that the application will amount to embarrassing his client who is the 1st defendant, and cited various authorities to support his argument.

In his ruling on the application, justice longji hold that the application can not in any way embarrass the 1st defendant as insinuated by the counsel to the 1st defendant, as the case is already on the public domain, and however ruled in favor of the prosecutor for the amendment of the charges.

In what could be best describe as in quick succession, the 1st defendant through his counsel Edward Pwajok (SAN) move to apply that the court should rule that all the prosecution witnesses earlier cross examined should be presented for re- cross examination.

The application was however granted on the ground that the amended charges has summersault the whole charges so the need for all the prosecution witnesses to be re-cross examine.

The 2nd defendant who is not opportune to be join in the amended charges despite some of the amended charges affect his client Yakubu Pam threaten to challenge it in the appeal court.

The counsel to the 2nd defendant Oguntuyi said the amended charges 9,10,11and 12 directly affect my client ,closing us out is against our fundamental human right to fair hearing we shall study it carefully with the view to know the next line of action to take.

The case had been adjourned to Oct, 30th, 31st and 1st Nov, 2019 for re-cross examination of the prosecution witnesses.

By,Giwa Alex, Jos

Prof. Mailafia oral application urging the court to ban journalists from reporting the court case between him and one Mr Masara Kim has been over rule by the judge.

The oral application of professor Mailafia represented by his counsel A.A Abrahim is predicated on the ground that the continue reportage help to expose the content of the case instead of playing it down which is helping to add salt to injury.

The judge was quick to disagree with the plaintiff counsel on the ground that journalists aside having beats which court is one, have unique way which they write to communicate to there larger audience /readers.

In his response, the defendant counsel replied that he would only respond to the plaintiff’s Counsel if he present a written application on the matter.

Plaintiff’s Counsel, Barr. A. A Ibrahim who is handling a Defamation Case between Prof. Dimis Mailafiya against Masara Kim Usman, Tue 8th, Oct, 2019 was visibly unhelpful in his misgivings against Journalists reporting court proceedings.

Prof. Dimis Mailafiya, the Director General of the Plateau PDP Gubernatorial Campaign Council, in the 2019 election had early this year filed defamation charges against a Jos based Journalist, Masara Kim, demanding about N50 million damages.

Kim, according to our findings has been dragged to court in January 2019, over a news report he published on his news blog, http://www.masarakimsblog.com in October 2018, wherein the Sen. Jeremiah Useni’s campaign DG was accused of allegedly collecting bribe to shortchange and back a supposedly unpopular running mate for his boss.

When the matter came up for hearing, Kim and his team of Lawyers head by Nanle Komak from Komak Law firm appeared in the court alongside counsels to the plaintiff Barr. A. A Ibrahim to proceed on the matter.

But with surprises, the defendant’s applicant Counsel, Barr. Komak moved to file an application for a motion on notice for the extension of time to enable the Defendant file his statement of defense.

The application was not opposed by the plaintiff Counsel, Barr. A. A. Ibrahim, making the proceedings Judge to fix January 27th 2020 for the continuation of hearing.

The defendant had in a statement of defence through his counsel in January 2019 filed a motion seeking to strike out the case as well as filed a followup to a memorandum of appearance filed in May 2019,

The defendant was issued a notice of intention to go to court in November 2018 by Prof. Mailafiya’s Councils, M.Y Saleh (SAN) & Co law firm.

At the expiration of the grace period within which the said defamatory news story was expected to be retracted, Kim was served a writ of summons in January 2019.

The University of Jos Professor of Economics is demanding a N50,000,000.00 relief for the offense, a retraction and an order restraining the Publisher of http://www.mkreporters.media from publishing any further ‘defamatory’ story against him.

Kim is however contending that the news report in question is not assertive and was published with no ill-will after offering a chance for defence which was not exploited by the complainant.

Gen. Useni  Head To Appeal Governorship Election  Tribunal  Judgement.

By, Giwa Alex, jos

Gen. J.T Useni of the People Democratic party(PDP)in plateau state has head to appeal the judgement of governorship election tribunal sitting in Jos the plateau state capital that dismissed his election petition against governor Bako Lalong of the All progressive Congress (APC)for lack of merit.

As the immediate past senator in the 8th National Assembly has

call on his followers to remained calm as he is going to explore all legal window to claim the mandate given to him by the people of plateau State.

In a press statement made available to this medium and signed by the his media consultant yiljap Abraham read,

“Following the judgement of the Governorship Election Petition Tribunal in Jos on Wednesday, October 2, 2019, the PDP Plateau Governorship Candidate Senator (Lt. Gen) Jeremiah Timbut Useni has been fully briefed by his Legal Team on the outcome of his petition.”

“He has expressed his appreciation to his legal experts and said he maintains his confidence in them.”

“He has also expressed confidence in the Nigerian judiciary to do substantial justice.”

Consequently, General Useni is convinced that there are many grounds to appeal the judgement. He has therefore instructed the legal team to take all processes with immediate effect and proceed on appeal against today’s judgement.

Gen. Useni is further encouraged by the fact that the Supreme Court had last week upheld his interlocutory appeal against a Court of Appeal judgement which expunged the testimonies of 21 of his witnesses earlier considered by the tribunal. Unfortunately, the tribunal did not avert its mind to the Supreme Court judgement which in turn affected today’s judgement.

In addition, the bulk of the tribunal’s findings are in fact in favour of his petition, for example, the fact that Governor Simon Bako Lalong did indeed give false information on oath. But surprisingly, the tribunal did not give any consequential order to nullify his election.
